1. The procedure is conducted for the purpose of concluding a framework agreement for the supply of data carriers. 2. Partial offers are allowed to be submitted in two tasks: 1) Task 1 – Supply of data carriers: disks; 2) Task 2 – Supply of data carriers: tapes. 3. The detailed description of the subject of the order is Annex No. 5A-5B and Section XIX SWZ and Section XIX/XIXa SWZ (according to the task). 4. The ordering party requires the indication in the Price Form of the Manufacturer, type/model/version or other data unambiguously identifying the offered assortment. In the event that the offer does not indicate data unambiguously identifying the offered assortment, the ordering party will reject the offer on the basis of Article 226(1)(5) of the Act. The term "Manufacturer" shall mean the name of the company under which the offered assortment is sold, or the entrepreneur introducing the goods into circulation in the territory of the Republic of Poland. 5. 6. The contractor will be obliged to provide a minimum 24-month warranty and guarantee for the supplied assortment, calculated from the date of signing by the Parties without remarks in the protocol of quantitative acceptance of the delivery. 6. The ordering party does not require the submission of substantive evidence with the offer. 7. The ordering party allows the assignment of part of the order to a Subcontractor. 8. The ordering party requires the contractor to indicate in the offer which part of the order will be assigned to Subcontractors and to provide the names of any Subcontractors, if they are already known. 9. Delivery deadline for the assortment in each task: within 30 working days, counted from the date of conclusion of the execution contract or acceptance of the request. 10. The deadline for binding the offer in each task is 21.11.2026. 11. The ordering party will make changes to the contract in accordance with Section XIX SWZ. 12. In accordance with Article 13(1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 04.05.2016, p. 1), hereinafter referred to as "GDPR", the ordering party informs that: 1) the controller of your personal data is the Commander of the Capital Police; 2) supervision over the proper processing of personal data is carried out by the data protection inspector: address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: [email protected] 3) your personal data will be processed on the basis of Article 6(1)(c) GDPR for the purpose related to the procedure conducted in the tender procedure for the conclusion of a framework agreement for the supply of data carriers (Procedure number: WZP-2206/26/118/Ł). 4) the recipients of your personal data will be persons or entities to whom the documentation of the procedure will be made available on the basis of Article 18 and Article 74(1) of the Act; 5) your personal data will be stored in accordance with Article 78 of the Act for a period of 4 years from the date of completion of the procedure for the award of the order, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide your personal data directly concerning you is a statutory requirement specified in the provisions of the Act, related to participation in the procedure for the award of a public contract; the consequences of not providing the specified data result from the Act; 7) with regard to your personal data, decisions will not be made in an automated manner, in accordance with Article 22 GDPR; 8) you have: a) the right, pursuant to Article 15 GDPR, to access your personal data; b) the right, pursuant to Article 16 GDPR, to rectify your personal data; c) the right, pursuant to Article 18 GDPR, to request the controller to restrict the processing of your personal data, with the exception of the cases referred to in Article 18(2) GDPR; d) the right to lodge a complaint with the President of the Personal Data Protection Office, if you consider that the processing of your personal data infringes the provisions of GDPR; 9) you do not have: a) the right, pursuant to Article 17(3)(b), (d) or (e) GDPR, to erasure of personal data; b) the right to data portability, as referred to in Article 20 GDPR; c) the right, pursuant to Article 21 GDPR, to object to the processing of personal data, as the legal basis for the processing of your personal data is Article 6(1)(b), (c) and (f) GDPR. 13. The ordering party does not require the contractor to demonstrate compliance with the conditions specified in Article 112(2) of the Act. 14. The subject order may be sought by contractors who are not excluded on the basis of Article 108(1) and (2) of the Act, Article 109(1)(1), (4), (7), (8) and (10) of the Act and Article 7(1) of the Act of 13.04.2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security (Journal of Laws of 2025, item 514) and Article 5k of Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014, p. 1), hereinafter: Regulation 833/2014, in the wording given by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 111, 8.4.2022, p. 1).
