The assessment of the fulfillment of the conditions required from the Contractors will take place according to the formula: “meets – does not meet”, on the basis of the information contained in the submitted declarations and documents. 7. The Contracting Authority requires the submission of a bid bond for the period of tender validity. The bid bond is maintained continuously until the day the tender validity period expires, except for cases referred to in Article 98(1)(2) and (3) and (2) of the Act. 8. The bid bond should be submitted before the deadline for submitting tenders. A tender from a Contractor who does not submit a bid bond or submits it incorrectly will be rejected. 9. A bid bond submitted in a form other than cash must, in particular, specify an unconditional, irrevocable obligation to pay at the first request of the Contracting Authority in the cases specified in Article 98(6)(1)-(3) of the Act and be valid for the period of tender validity specified in this SWZ. The bid bond may not contain provisions limiting the obligation to pay the bid bond. 15. The bid bond should be delivered to the Contracting Authority in the same form in which it was issued by the guarantor or surety (in the original). 16. A bid bond submitted in the forms specified in Article 97(7)(2)-(4) of the Act, in the case of Contractors jointly applying for the contract, must include in its content all Contractors jointly applying for the contract or it must be clear from the content of the bid bond that it secures the tender of Contractors jointly applying for the contract (consortium). 17.
