1. The public procurement procedure is conducted as an open tender, pursuant to Article 132 of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793), hereinafter referred to as the “Public Procurement Act”, the executive regulations issued thereon, and the Civil Code. In matters not regulated by this SWZ, the provisions of the Public Procurement Act shall apply. 2. The contracting authority, in accordance with Article 139 of the Public Procurement Act, provides for a reversed order of actions, i.e., it may first conduct an examination and evaluation of offers, and then conduct a qualification of the Contractor whose offer has been most highly evaluated, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. 3. The subject matter of the contract is described in Annex 9 to the SWZ. 4. The Contractor is obligated to execute the contract on the principles and conditions described in the Draft Contract Terms constituting Annex 8 to the SWZ. 5. The contracting authority shall invalidate the procedure pursuant to Article 257 of the Public Procurement Act in the event of non-approval of funds for the financing of the contract.
