Poland – Antineoplastic agents – Dostawa środków przeciwnowotworowych, w podziale na 75 części.

The subject of the contract is the delivery of anti-cancer agents in 75 parts. The subject matter evidence regarding the lack of grounds for exclusion from participation in the procedure, submitted by the contractor whose offer was highest rated (within the time limit set by the Contracting Authority, not shorter than 10 days): 1) Information from the National Criminal Register in the scope specified in: a) Article 108(1)(1) and (2) PZP, b) Article 108(1)(4) PZP, regarding the court order prohibiting participation in public procurement proceedings as a criminal penalty, – issued no earlier than 6 months before its submission. 2) A declaration by the Contractor, within the meaning of Article 108(1)(5) PZP, of not belonging to the same capital group within the meaning of the Act of 16 February 2007 on the protection of competition and consumers (Journal of Laws of 2023, item 1689), with another contractor who submitted a separate offer, or a declaration by the Contractor of belonging to the same capital group together with documents or information confirming the preparation of the offer independently of another Contractor belonging to the same capital group. 3) A certificate from the competent head of the tax office confirming that the Contractor does not owe taxes and fees, within the meaning of Article 109(1)(1) PZP, issued no earlier than 3 months before its submission, and in the event of arrears in the payment of taxes or fees – together with the certificate the Contractor is obliged to submit documents confirming that before the deadline for submitting offers the Contractor made the payment of the due taxes or fees together with interest or penalties or concluded a binding agreement on the repayment of these liabilities. 4) A certificate or other document from the competent territorial organizational unit of ZUS or the competent regional branch or competent local unit of the Agricultural Social Insurance Fund confirming that the Contractor does not owe social and health insurance contributions, within the meaning of Article 109(1)(1) PZP, issued no earlier than 3 months before its submission, and in the event of arrears in the payment of social or health insurance contributions – together with the certificate or other document the Contractor is obliged to submit documents confirming that before the deadline for submitting offers the Contractor made the payment of the due social or health insurance contributions together with interest or penalties or concluded a binding agreement on the repayment of these liabilities. 5) A copy or information from the National Court Register or from the Central Register and Information on Business Activity, within the meaning of Article 109(1)(4) PZP, prepared no earlier than 3 months before its submission, if separate regulations require entry in the register or record. 6) If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in Section VI, Part A, Article 3 of the SWZ: a) point 1 – submits information from the appropriate register, such as the commercial register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence or the person to whom the information or document relates, within the meaning of Section VI, Part A, Article 3(1) of the SWZ, issued no earlier than 6 months before its submission; b) points 3, 4, 5 – submits a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming respectively, that: – it has not breached obligations related to the payment of taxes, fees, or social or health insurance contributions, – its liquidation has not been opened, bankruptcy has not been announced, its assets are not managed by a liquidator or a court, it has not concluded an agreement with creditors, its business activity is not suspended or it is not in a similar situation resulting from a similar procedure provided for in the provisions of the place of commencement of that procedure; – issued no earlier than 3 months before their submission. 7) If in the country in which the Contractor has its registered office or place of residence or the person to whom the document relates has a place of residence, the documents referred to in point 7) are not issued, or if these documents do not relate to all the cases referred to in Article 108(1)(1), (2) and (4), Article 109(1)(1) PZP, they are replaced in whole or in part by a document containing a declaration by the Contractor, indicating the person or persons authorized to represent it, or a declaration by the person to whom the document was to relate, submitted under oath, or, if in the country in which the Contractor has its registered office or place of residence or the person to whom the document was to relate has a place of residence, there are no provisions on the declaration under oath, submitted before a judicial or administrative authority, notary, professional or economic self-government body, competent in respect of the registered office or place of residence of the contractor or the place of residence of the person to whom the document was to relate. The deadlines for issuing documents and declarations, referred to in the preceding sentence, shall be applied accordingly to the deadlines referred to above in point 6 lit. a – b above. 8) Each of the Contractors jointly applying for the award of the contract shall submit the documents referred to above in Section VI, Part A, Article 3. The Contractor may replace the documents indicated in points 2 and 3 above with a public procurement contractor certificate, if the scope of certification confirms the fulfilment of the condition of participation in the procedure and the lack of grounds for exclusion which were specified by the Contracting Authority. In the event of submission of the certificate, the Contracting Authority shall assess it in terms of the scope of certification, currency and compliance with the requirements specified in the SWZ. In the scope not covered by the certificate, the contractor is obliged to submit the subject matter evidence required by the Contracting Authority.
