Poland – Electricity, heating, solar and nuclear energy – Zakup energii elektrycznej dla grupy zakupowej utworzonej przez Gminę Oborniki

1. Contract title: Purchase of electricity for a purchasing group created by the Municipality of Oborniki. 2. The supply of electricity will be carried out in accordance with the applicable law, in particular the terms set out by the Act of 10 April 1997 on Energy Law (i.e. Journal of Laws of 2026, item 43 as amended) and the implementing regulations to this Act. 3. The contract covers the supply of 4,995,692 kWh of electricity from 01.01.2027 to 31.12.2027 to the points of electricity supply in accordance with Annex No. 1 to this specification. 4. The supply of electricity will be carried out on the basis of an electricity supply contract, as referred to in Article 5(2)(1) of the Energy Law. 5. This contract does not include the provision of electricity distribution services. 6. Quality requirements: 1) The supply of electricity will be carried out on the terms set out in the Act of 10 April 1997 - Energy Law and in accordance with the implementing regulations issued to this Act. Distribution services will be provided on the basis of a separate contract concluded by the Contracting Authority with the relevant Distribution System Operator (DSO). 2) The Contractor is obliged to perform the function of the entity responsible for commercial balancing for the electricity sold within the subject of the contract. 3) The Contractor is obliged to have, for the entire period of implementation of this contract, agreements with the Distribution System Operator, i.e. ENEA OPERATOR Sp. z o.o., enabling the conclusion of effective agreements for all the points of supply covered by the SWZ, operating within the Contracting Authority's area, enabling the sale of electricity through the DSO's distribution network to the points of electricity supply, specified in Annex No. 1. 7. The Contracting Authority informs that for all points of electricity supply, the procedure for changing the supplier is being carried out for the next time. 8. All points of supply have contracts divided into an electricity supply contract (for a specified period until 31 December 2026) and a contract for the provision of distribution services (for an unspecified period). 9.
