The subject of the contract is the purchase of an excavator-loader and a wheel excavator (divided into parts), i.e.:

1) Part I: purchase of an excavator-loader

2) Part II: purchase of a wheel excavator

2. The task will be carried out within the framework of the Civil Protection and Defence Programme.

3. The contracting authority reserves the right to invalidate the procurement procedure in the event that the public funds from the Civil Protection and Defence Programme, which the contracting authority intended to allocate for the financing of the contract, are not granted to it (Article 310 of the Act).

5. The subject of the contract, which includes the purchase and delivery of the respective excavator-loader and wheel excavator to the place indicated by the contracting authority, is described in Annex No. 5 to the SWZ.

6. Warranty and guarantee:

1) The contractor shall provide a warranty for the completed contract subject for a period of 24 months, from the date of signing the contract acceptance protocol; The warranty period shall be extended for the time from the date of detection of the defect to the date of its removal.

2) The contractor shall provide a guarantee for the completed contract subject for a period proposed in the offer, from the date of signing the contract acceptance protocol.

3) The guarantee conditions shall be determined in Annex No. 7 to the SWZ.

7. Subject evidence means:

1. The contracting authority requires the submission of subject evidence means, i.e. a description of the offered excavator-loader and wheel excavator, containing at least the name, technical parameters, equipment and other information (in order to determine compliance with the contract subject description contained in Annex No. 5 to the SWZ).

2. Pursuant to Article 107(2) of the Act, if the contractor does not submit the subject evidence means or the submitted subject evidence means are incomplete, the contracting authority shall call for their submission or completion within a specified deadline, with the reservation of Article 107(3) of the Act.
