Description

1. The subject of the Order in the context of tasks based on a framework agreement will be the preparation of Reports on the reassessment of the environmental impact of the Investment „Construction and operation of the first nuclear power plant in Poland, with an electrical capacity of up to 3750 MWe, in the area of the municipality of Choczewo.

2. A detailed description of the subject of the Order is contained in Annex A to the Draft Contractual Provisions, which constitute Annex No. 1 to the SWZ.

3. The subject Procedure is conducted in the form of an unrestricted tender, based on Article 132 in conjunction with Article 378 of the Act of 11 September 2019 - Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended), (hereinafter: the Pzp Act).

4. The provisions of the Act of 29 June 2011 on the preparation and implementation of investments in the field of nuclear energy facilities and related investments (Chapter 6) (i.e. Journal of Laws of 2025, item 1156, as amended), hereinafter referred to as the Investment Act, also apply to the subject Procedure.

5. Whenever this Notice refers to the Specification or SWZ, it means the Specification of Order Conditions together with the annexes, which are an integral part of it.

6. The Purchaser informs that the public procurement procedure will be conducted using the Purchaser's Procurement Platform.

7. The address of the website of the conducted Procedure: https://pz.pej.pl (under this address, changes and clarifications of the content of the SWZ and other documents of the Order directly related to the Procedure for the award of the Order will be made available).

8. In this procedure, communication between the Purchaser and the Contractors, including the submission of Offers, exchange of information and transmission of documents or declarations, with the exception of the exceptions indicated in the Pzp Act, takes place using electronic communication means via the Platform, available at the address: https://pz.pej.pl.

9. A Contractor intending to participate in the procedure for the award of the Order must have an account on the Procurement Platform. Registration and maintenance of an account on the Procurement Platform as well as the use of the Platform is free of charge.

10. The technical and organisational requirements for using the Platform are specified in the Platform Regulations (available at the internet address https://pz.pej.pl/user/terms). A Contractor, by participating in the procedure for the award of the Order, i.e. by registering free of charge or logging in (in the case of having an account on the Platform), accepts the terms of use of the Platform, specified in the Regulations, and acknowledges them as binding.

11. Detailed information on electronic communication means is provided in point 17 of the SWZ.

12. The Purchaser, pursuant to Article 139(1) of the Pzp Act, provides for a so-called reverse procedure, i.e. first carries out an examination and evaluation of Offers to determine the highest-rated Offers, and then carries out a subject qualification of Contractors, whose Offers have been rated highest, in terms of lack of exclusion grounds and fulfilment of the conditions for participation in the Procedure. Information in this regard is contained in point 15 of the SWZ.

The Contractor, to confirm the lack of exclusion grounds, is obliged to submit with the Offer: 13.1) Pursuant to Article 393(1)(3) of the Pzp Act, in order to demonstrate the lack of exclusion grounds, as referred to in point 13.3 of the SWZ, the Contractor submits a declaration, the template of which is Annex No. 10 to the SWZ. 13.2) In the case of relying on the capacities or situation of other entities providing resources, the Contractor, together with its declaration referred to in point 13.1) above, also submits a declaration from the entity providing the resources, confirming the lack of exclusion grounds. 13.3) In the case of joint participation in the Order by Contractors, the declaration referred to in point 13.1) above is submitted by each of the Contractors jointly applying for the Order. 13.4) In the case where the Contractor plans to entrust part of the Order, constituting more than 10% of the value of the Order, to subcontractors and suppliers, and they are known, the Purchaser requires the Contractor to present a declaration, as referred to in point 13.1) above, in respect of those subcontractors and suppliers.

14. The Purchaser, in accordance with Article 139(2) of the Pzp Act, in connection with point 2.3 of the SWZ, will require the submission of a JEDZ declaration, exclusively from the Contractor whose Offer is rated highest. Information in this regard is contained in point 15 of the SWZ.

15. The Purchaser, before selecting the most advantageous offers, will call upon the Contractors, whose offers have been rated highest, to submit, within a specified period, not shorter than 10 days, declarations and subject evidence, current as of the date of submission, as referred to in point 15 of the SWZ.

16. Pursuant to Article 42(2) of the Investment Act, the Purchaser informs that in the event that the Contractor does not submit the subject evidence required by the Purchaser, as referred to in point 15.4 of the SWZ, or does not submit powers of attorney, or submits the subject evidence required by the Purchaser, as referred to in point 15.4 of the SWZ, containing errors, or submits invalid powers of attorney, within a specified period, not more than three times, unless their submission results in the rejection of the Contractor's Offer or the Procedure would have to be invalidated. The evidence submitted at the request of the Purchaser should confirm the Contractor's fulfilment of the conditions for participation in the Procedure and the fulfilment of the requirements for the offered services specified by the Purchaser, no later than on the day on which the deadline for submitting Offers expired.

17. Information on the subject evidence regarding Contractors having their registered office or place of residence outside the territory of the Republic of Poland is provided in points 15.6-15.8 of the SWZ.
