Description
The subject of the contract is the supply of a subscription to SolarWinds Observability Self-Hosted Advanced for Enterprise AE1000 along with the manufacturer's support. The detailed description of the subject of the contract contains the contract template along with the annexes, which is Annex No. 10 to SWZ. 2. The contracting authority in this procedure does not divide the contract into parts or allow the submission of partial bids: The subject of the contract entitled: “Extension of the 36-month subscription to SolarWinds Observability Self-Hosted Advanced for Enterprise AE1000 with the possibility of monitoring the performance of websites (WPM), along with the manufacturer's support” should not be divided into parts, due to its nature – that is, for technical, organisational and purposeful reasons, since it constitutes a coherent whole in terms of technology, and all its elements are interrelated and affect the correctness, safety and effective quality of the solution. Dividing the contract into parts could lead to problems with compatibility, integration and responsibility for the operation of the solution as a whole. The system requires a uniform configuration, coordinated updates and version compatibility, which, when implemented by different contractors, would increase the risk of errors, downtime and delays in implementations. Implementing the contract by one contractor enables comprehensive and coherent technical support from the manufacturer, including uniform incident handling rules, one SLA level and clear responsibility for the system. This eliminates the risk of shifting responsibility between contractors and speeds up the resolution of technical problems. Furthermore, one contractor enables the implementation of uniform security policies and simplifies the management, reporting and settlement of support services, which translates into the optimisation of the contracting authority's costs and resources. In the opinion of the contracting authority, the nature of the subject of the contract does not allow the contract to be divided into parts – such a division would fundamentally threaten the coherence of its proper implementation. The decision not to divide the contract into parts does not deprive small and medium-sized enterprises of the opportunity to participate in the procedure. For the above reasons, it is not possible to divide the contract into parts. 3. The contracting authority does not require the contract to be implemented by sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94(1) of the Act. 4. Due to the nature of the contract (supply), the contracting authority does not require the employment of persons on the basis of an employment relationship. 5. The contracting authority does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(8) of the Act. 6. The contracting authority does not allow the submission of variant bids. 7. The contracting authority does not envisage the conduct of an electronic auction. 8. The contracting authority did not conduct preliminary market consultations before initiating the procedure. 9. The contracting authority does not require contractors to submit a substantive means of proof in this procedure. 10. The contracting authority, within the limits set out in Article 462 and subsequent provisions of the Act, allows the possibility of implementing the subject of the contract by the contractor using subcontractors. A contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the bid the parts of the contract whose execution they intend to entrust to subcontractors (including suppliers) and shall provide the names of any potential subcontractors (including suppliers) if they are already known.
