Subject of the contract: Purchase and delivery of liquid fuels divided into 3 tasks, namely: Task No. 1 – Purchase and delivery of diesel oil ON to non-stationary tanks of the "FUELMASTER" type located on the premises of the Provincial Police Headquarters with its seat in Radom Task No. 2 – Purchase and delivery of diesel oil ON to a non-stationary tank of the "FUELMASTER" type located in Płock Task No. 3 – Purchase of diesel oil ON and unleaded petrol PB 95 for service vehicles operated in the County Police Headquarters in Łosice A detailed description of the subject of the contract is contained in: - Annexes No. 1.1 – 1.3 to SWZ – DESCRIPTION OF THE SUBJECT OF THE CONTRACT - Annex No. 2.1 – 2.3 to SWZ – contract draft for Task No. 1-3, - Annex No. 7 to SWZ – Tender Form, The logistical resources may be used by the City Commander of the Police in Radom as the Recipient, on the terms indicated in the tender documents. The Contractor is bound by the offer until 20.02.2027, whereby the first day of the offer binding period is the day on which the offer submission deadline expires. Contract performance period: The contract period is set for 24 months from the date of conclusion or until the earlier exhaustion of the amount allocated for the implementation of the contract within the framework of individual tasks, depending on which of these circumstances occurs earlier. The planned provisions of the contract regarding the public contract, which will be introduced into the contract regarding the public contract Contract amendment: The planned provisions of the contract regarding the contract, which will be introduced into the content of this contract, have been specified in Annexes No. 2.1., 2.2., 2.3 to SWZ. The Contracting Authority may withdraw from the contract, in cases specified in the generally applicable provisions, in particular in Article 456 of the Act of 11 September 2019 on Public Procurement. The Contracting Authority allows for the change of provisions of the concluded contract in relation to the content of the offer on the basis of which the Contractor was selected, in the following cases and on the conditions specified below: a) it is permissible to reduce the Contractor's remuneration while maintaining the scope of his contractual services; b) it is permissible to change the contract by changing the Contractor's data without changing the Contractor himself (e.g. change of registered office, address, name); c) it is permissible to extend the contract period in the event that the Contracting Authority and the Recipient do not use the amount referred to in §2 para. 2 of the contract draft, but not longer than for a further 24 months. TO THE TENDER SHOULD BE ATTACHED: 1) Tender Form (tender) – Annex No. 7 to SWZ. In the event that the contractor does not use the template prepared by the contracting authority, the tender must include all the information required in the Tender Form. 2) Declaration by the Contractor that the offered liquid fuel (diesel oil ON) is in accordance with the standard PN-EN 590:2022-08 or its replacement and the requirements set out in the Regulation of the Minister of Climate and Environment of 26 June 2024 on the quality requirements for liquid fuels (Journal of Laws of 2024, item 1018 as amended) – (the template is Annex No. 9 to SWZ) – required for Task No. 1 3) Declaration by the Contractor that the offered liquid fuel (diesel oil ON) is in accordance with the standard PN-EN 590:2022-08 or its replacement and the requirements set out in the Regulation of the Minister of Climate and Environment of 26 June 2024 on the quality requirements for liquid fuels (Journal of Laws of 2024, item 1018 as amended) – (the template is Annex No. 10 to SWZ) – required for Task No. 2 4) Declaration that the offered liquid fuel (diesel oil ON) is in accordance with the standard PN-EN 590:2022-08 or its replacement and the requirements set out in the Regulation of the Minister of Climate and Environment of 26 June 2024 on the quality requirements for liquid fuels (Journal of Laws of 2024, item 1018 as amended) – (the template is Annex No. 11 to SWZ) – required for Task No. 3. 5) Power of attorney authorising the submission of a tender, if the tender is submitted by a proxy; 6) Power of attorney for the proxy to represent contractors jointly applying for the award of the contract (consortium, civil law partnership) – applies to tenders submitted by contractors jointly applying for the award of the contract; The power of attorney to submit a tender must be drawn up in electronic form, signed with a qualified electronic signature. The power of attorney is submitted in electronic form and is affixed with a qualified electronic signature. In the event that the power of attorney was drawn up in paper form, a digital copy of this document (scan) affixed with a qualified electronic signature, certifying the conformity of the digital copy with the document in paper form, is submitted. The conformity of the digital copy with the document in paper form is certified by the contractor or a notary; 7) Declaration of contractors jointly applying for the award of the contract (consortium, civil law partnership) referred to in Article 117 para. 4 of the Act, from which it follows which supplies are made by the individual contractors, submitted in accordance with Section XVII para. 2 point 3 SWZ – (the template is Annex No. 8 to SWZ) 8) The tender must be submitted under pain of invalidity in electronic form, i.e. electronic form affixed with a qualified electronic signature.
