The procedure for awarding the contract is conducted in the form of an unrestricted tender, as referred to in Article 132 of the Act on Public Procurement, hereinafter referred to as the "Act on Public Procurement". 5.1. Task name assigned by the Purchaser: Transportation of students from the area of the Gmina Białe Błota to educational facilities. The detailed scope of the subject of the contract is described in the draft contract and Volume III of the SWZ. The Specification of Contract Conditions and all documents constituting its annexes are made available by the Purchaser on the dedicated page of the procurement platform at http://platformazakupowa.pl/pn/bialeblota 5.2. CPV (Common Procurement Vocabulary): Main subject: 60172000-4 Rental of buses and coaches with driver 5.3. The Specification of Contract Conditions is hereinafter referred to as the "SWZ" or "Specification". 5.4. Description of the subject of the contract. The subject of the contract is described in detail in Volumes II and III of this SWZ. 5.5. The Purchaser does not allow the submission of partial offers. The scope and nature of the services covered by the procedure require them to be included in one contract due to the special nature of the service. The Purchaser requires that the organisation of services be carried out within one company to ensure comprehensive, coordinated organisation of student transportation and uniform service standards. The lack of division of the contract into parts is justified by organisational, logistical reasons and ensuring proper quality and continuity of transport services. 5.6. The Purchaser does not allow the submission of variant offers. 5.7. The execution of the contract is subject to Polish law, including in particular the Civil Code and the Act on Public Procurement. The Contractor will be obliged to perform the services in accordance with Polish law. 5.8. The Purchaser does not provide for the possibility of awarding contracts, as referred to in Article 214(1)(7) of the Act on Public Procurement. 5.9. The Purchaser does not require Contractors to conduct a site visit, as referred to in Article 131(2) of the Act on Public Procurement. 5.10. The requirements for the employment by the Contractor or subcontractor, based on an employment contract, of persons performing the tasks indicated by the Purchaser in the scope of contract implementation have been specified in the further part of the SWZ. The above requirements specify in particular: a) the type of tasks related to contract implementation, which are subject to employment requirements based on an employment contract by the Contractor or Subcontractor of persons performing tasks during contract implementation, b) the method of verifying the employment of these persons, c) the Purchaser's entitlements in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons and the sanctions for non-compliance with these requirements, The Purchaser requires the employment, based on an employment contract, by the Contractor or Subcontractor of persons performing all physical work related to the performance of all tasks covered by the contract and described in the OPZ, the performance of which consists in performing work in the manner specified in Article 22(1) of the Act of 26 June 1974 - Labour Code: drivers holding authorisations to drive buses, coaches and/or vehicles. The method of verifying the employment of persons performing work in the manner specified in Article 22(1) of the Act of 26 June 1974 - Labour Code and the Purchaser's entitlements in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons and the sanctions for non-compliance with these requirements have been specified in the draft contract, constituting an integral part of the SWZ. 5.11. The Purchaser does not specify the requirements referred to in Article 96(2) of the Act on Public Procurement. 5.12. The Purchaser does not reserve the right to apply for the award of the contract exclusively to contractors, as referred to in Article 94 of the Act on Public Procurement. 5.13. The Purchaser requires, in accordance with the description of the subject of the contract, that the subject of the contract be implemented with due regard to the requirements in the scope of accessibility for disabled persons. 5.14. The Purchaser does not require the submission of electronic catalogues with the offer. 5.15. The Purchaser does not provide for settlement in foreign currencies. 5.16. SUB-CONTRACTING AND KEY PARTS OF THE CONTRACT: a) The Purchaser does not reserve the obligation for the Contractor to personally perform key parts of the contract. b) The Contractor may entrust the performance of part of the contract to a subcontractor. c) The Purchaser requires the Contractor to indicate the parts of the contract, the performance of which the Contractor intends to entrust to subcontractors, and to provide the names of the subcontractors, if known, in accordance with point 10.7 of the IDW. d) Other requirements regarding subcontracting have been specified in Volume II of the SWZ - draft contractual provisions.
