The present public procurement has as its subject the performance of the functions of a consultant/construction supervisor and an Engineer under the FIDIC Yellow Book Contract Conditions for the project: "Reconstruction and expansion of the internal sewerage network and the accompanying water supply branches in the town of Lyaskovets". SUBJECT OF THE CONTRACT

An Engineer as per Clause 3 of “Contract Conditions for Technological Equipment and Design – Construction for Electrical and Mechanical Installation Works and for Construction and Engineering Projects Designed by the Contractor. General Conditions”. International Federation of Consulting Engineers (FIDIC), 1st ed., 1999, Edition in Bulgarian translation: Bulgarian Association of Architects and Engineering Consultants, as well as the relevant Specific Conditions, as well as the Appendix to the tender offer under the engineering contract; Technical control during the design under the design and construction (engineering) contract by preparing a report/evaluation of the compliance of the investment project for the above-mentioned object; Assessment of compliance in terms of Constructive as per Art. 142, para. 10 of the ZUT, where applicable Construction Supervision as per Art. 168 of the ZUT; Coordinator "safety and health" for the construction stage for the object, specified at the beginning of these Specifications and in accordance with the conditions of the public procurement, specified in Section 1. The execution of the present contract is in accordance with the above-mentioned. The contract covers the following services (which does not exclude the assignment of additional tasks in the process of executing the contract in accordance with specific needs and specifics):

Review, assessment of compliance with the contractual requirements and approval of the Contractor's Programme; Review, assessment of compliance with the contractual requirements and approval of the revised (one or more) Contractor's Programme; Control of the execution of the Contractor's Programme; Review and opinion on the investment project prepared by the Contractor regarding its compliance with the Requirements of the Employer; Preparation of a comprehensive report on the assessment of the compliance of the investment project, as well as identical comprehensive reports during the execution of the construction, incl. assessment of compliance in terms of "Constructive" as per Art. 142, para. 10 of the ZUT; Carrying out documentary and physical checks for compliance of the materials and equipment placed in the object up to the stage of their approval; Actions for consideration and approval of the Contractor's insurances; Actions for consideration and approval of the Contractor's guarantees, issued in connection with the performance of his contractual obligations; Actions for issuing decisions by the Engineer; Actions in case of unforeseen physical conditions established by the Contractor; Actions of the Engineer in case of non-performance by the Contractor of actions for environmental protection; Carrying out documentary and physical checks of the construction process; Issuing of interim payment certificates, incl. the actions preceding them; Actions of the Engineer, related to change procedures; Actions of the Engineer in relation to claims in accordance with the contract with the Contractor; Control over the preparation of acts and protocols during the construction; Organization and conduct of monthly progress meetings, incl. documentation of the results from them; Actions of the Engineer, related to trials (single and complex – at completion); Actions for issuing a Certificate of Acceptance of the Object; Actions for issuing a Certificate of Performance; Actions for performing the functions of a consultant/construction supervisor during the construction; Actions for performing the functions of a Safety and Health Coordinator during the construction. The services specified above are not exhaustive, as the Engineer is also engaged with all other obligations that are not explicitly mentioned, but arise from the provisions of the present contract and the provisions of the General and Specific Conditions of the construction contracts, where the relationships Employer – Contractor – Engineer are described in detail and cannot be repeated here, without repeating the entire text of the contractual conditions, which is why the same are attached to the present contract. For explicitly unregulated powers and competencies of the contractor under the present contract in his capacity as an Engineer, the same exercises his functions as they arise from the specific contractual conditions of the contract with the Contractor in case they do not contradict the applicable legislation. The contractor under the present contract is obliged to seek the written approval of the Employer before exercising his functions as an Engineer under FIDIC on the matters for which the sanction of the Employer is explicitly provided for in the clauses of the engineering contract with the Contractor.
