The subject of the contract is “Granting the right to tool software on a subscription model for a period of 48 months (licences in a subscription model) along with the provision of Support Services and the guarantee of hours for Additional Tasks”. The subject of the contract are ICT products, ICT services and ICT processes within the meaning of the Act of 5 July 2018 on the national cybersecurity system (i.e. Journal of Laws of 2026, item 20, as amended, hereinafter: “KSC”). The subject of the contract is divided into the following parts: Part A – extension of the subscription for the Tool Software for monitoring and managing the DB2 database along with the provision of Support Services or delivery of equivalent software along with support in a subscription model, for a period of 48 months and the guarantee of hours for Additional Tasks. The detailed description of the subject of the contract is Annex No. 2 to the Draft Contract Terms, which constitute Annex No. 2A to SWZ. Part B – extension of the subscription for the Tool Software for the basic functionality of DB2 and RACF along with the provision of Support Services or delivery of equivalent software along with support in a subscription model, for a period of 48 months and the guarantee of hours for Additional Tasks. The detailed description of the subject of the contract is Annex No. 2 to the Draft Contract Terms, which constitute Annex No. 2B to SWZ. Part C – extension of the subscription for the Tool Software for automating tasks on the mainframe platform along with the provision of Support Services or delivery of equivalent software along with support in a subscription model, for a period of 48 months and the guarantee of hours for Additional Tasks. The detailed description of the subject of the contract is Annex No. 2 to the Draft Contract Terms, which constitute Annex No. 2C to SWZ. For Part A, Part B and Part C of the contract: 1) The Contractor will provide the Purchaser within 5 working days from the date of signing the Contract electronically to the Purchaser's email address the necessary access data enabling the implementation of the subject of the Contract, including the download of the Software or equivalent software by the Purchaser; 2) The Contractor will grant a licence in a subscription model for the Software or equivalent software for a period of 48 months, from the date of delivery of the access data referred to in point 1), but not earlier than from 21.10.2026: For 891 MSU not earlier than from 21.10.2026 to 30.10.2027; For 3450 MSU from 31.10.2027 to the expiry of 48 months from the date of activation of the Subscription; 3) The Contractor will provide Support Services for the Software or equivalent software, Additional Tasks during the validity period of the Software Subscription or equivalent software. The Purchaser envisages awarding a supplementary contract in the maximum amount of: - for Part A – 17% of the value of the basic contract, - for Part B – 32% of the value of the basic contract, - for Part C – 17% of the value of the basic contract, in the scope of software delivery, in accordance with its subject and consisting in the repetition of additional deliveries, e.g. related to the need to supplement the functionality of the software being the subject of the basic contract or to improve the operation of the software being the subject of the basic contract, covering new areas of the Purchaser (e.g. an additional module for monitoring a system not previously covered). The supplementary contract will be awarded on the same terms as the basic contract.
