The subject of the contract is the successive supply and distribution of natural gas for the heating of the University of Rzeszow buildings. The Contracting Authority does not allow the submission of partial tenders. Reasons for not splitting the contract: The subject of the contract constitutes a functional whole, splitting the contract would entail excessive technical difficulties and excessive costs of contract performance, and the lack of splitting is justified by organisational reasons, as any splitting of the contract could seriously threaten the proper execution of the contract and the need to coordinate the actions of different contractors implementing individual parts of the contract could threaten the proper and timely execution of the contract. Furthermore, the lack of splitting does not violate competition by limiting the possibility of applying for it. 2. A detailed description and the manner of execution of the contract is contained in the Subject of the Contract Description (OPZ), which is Annex No. 1.1 to the SWZ. 3. Contractors who meet the following conditions may apply for the contract: 1) capacity to operate in business: The Contracting Authority does not set a condition in this respect. 2) authorisations to carry out a specific economic or professional activity, if this results from separate provisions: The Contracting Authority considers the condition to be met if the contractor has: - a current licence for the sale of gaseous fuels issued by the President of the Energy Regulatory Office in accordance with art. 32 para. 1 point 4 lit. a) of the Act of 10 April 1997 – Energy Law (Dz.U. 2022 item 1385 as amended) and - a current licence for conducting economic activity in the field of natural gas distribution issued by the President of the Energy Regulatory Office - in the case of Contractors being the owner of the distribution network, or - has a currently valid agreement with the Distribution System Operator (DSO) for the provision of natural gas distribution services in the area where the place of delivery of the gaseous fuel is located - in the case of Contractors not being the owner of the distribution network. The Contracting Authority will assess the fulfilment of these conditions on the basis of the submitted documents, evidence and declarations by the method 0-1 in the manner: meets / does not meet. 3) economic or financial situation: The Contracting Authority does not set a condition in this respect. 4) technical or professional capacity: The Contracting Authority does not set a condition in this respect. 4. The Contracting Authority envisages the application of the so-called reverse procedure, as referred to in art. 139 para. 1 of the PZP Act. 5. In accordance with art. 257 of the PZP Act, the Contracting Authority envisages the possibility of invalidating the subject matter of the proceedings if the public funds which the Contracting Authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. 6. The Contracting Authority does not require the submission of a bid bond. 7. The Contracting Authority does not require the provision of a guarantee of proper contract performance. 8.
