Poland – Medical equipments – Zakup i dostawa tomografu komputerowego oraz cyfrowego mammografu wraz z wyposażeniem, instalacją, uruchomieniem, przeprowadzeniem szkolenia personelu oraz wykonaniem niezbędnych prac adaptacyjnych.

1. The subject of the contract is the purchase and delivery of a computed tomography scanner and a digital mammography unit, including equipment, transport, installation, necessary adaptation work, installation, commissioning, and staff training for the University Clinical Hospital named after Fryderyk Chopin in Rzeszow. 2. The scope of the contract includes the delivery of the following devices in the quantities: • Part 1 – computed tomography scanner – 1 unit • Part 2 – digital mammography unit – 1 unit 3. The detailed specification and technical and functional requirements for Part 1 and Part 2 are specified in the Subject of the Contract Description (SOD), Annex 1 to SWZ. The price-offer forms (FCO) for Part 1 and Part 2, Annex 2 to SWZ, specify the scope subject to valuation, including the required number of devices. Annex 3 to SWZ – „Minimum scope of adaptation works” specifies the minimum scope of works necessary to implement the subject of the contract. The draft contractual provisions, Annex 11 to SWZ, specify the rules for implementing the subject of the contract. The indicated documents are an integral part of the SWZ. 4. For Part 1, the integral document of the contract is also Annex 14 to SWZ - „Technical expertise of the ceiling on the ground floor of the RTG room in building „A” of the University Clinical Hospital in Rzeszow, ul. Szopena 2, regarding the possibility of mounting the computed tomography scanner”, prepared on 21.07.2026. 5. Principles of equivalence and fair competition. 5.1. The requirements specified in the SOD are minimum requirements, with the exception of parameters subject to evaluation in accordance with the scoring rules specified in the SOD and SWZ. The subject of the contract is described in accordance with art. 16 and art. 99–101 of the Pzp, in a manner serving to maintain fair competition, equal treatment of contractors, transparency and proportionality. If the SOD refers to a trademark, patent, origin, source, special process, standard, European technical approval, approval, technical specification, system of technical references, specific technology, method, standard, design solution, trade name, function or other indication that may refer to a solution of a specific manufacturer, such a reference should be understood as „or equivalent”, to the extent permitted by the Pzp. The criterion of equivalence is the achievement of at least the required clinical functionality, safety, image quality, interoperability and user parameters important for the purpose of the given requirement. Equivalence does not require identical technical construction or identical method of function implementation, unless the specific feature or method of implementation has been indicated as an objectively justified limiting parameter. 5.2. Offering an equivalent solution does not exempt from the obligation to meet the limiting parameters, in particular the required numerical values, ranges and minimum or maximum values, unless the Contracting Authority has clearly specified the criterion of equivalence allowing for a different way of meeting the requirement for a specific parameter. The Contractor, referring to an equivalent solution, indicates in the offer the solution used and – exclusively within the scope provided for in the SWZ and in accordance with the provisions of the Pzp – submits the required documentary evidence or producer documentation enabling verification of the equivalence criteria. The burden of proving equivalence within the scope required by the contract documents rests with the Contractor. 5.3 The principles specified above apply to both parts of the contract and should be interpreted together with the relevant SOD. In case of discrepancies regarding the criteria of equivalence, the specific requirements of the relevant SOD are binding. 6. Due to the specificity of the subject of the contract and the need to adapt the existing premises for installation, commissioning and proper operation of the devices, the Contracting Authority requires the Contractor to conduct a site visit before the deadline for submitting offers. The site visit will take place on a single date, common to Part 1 and Part 2, i.e. on 1 October 2026 at 12:00, at the seat of the Contracting Authority. 7. Requirements regarding the „do no serious harm” (DNSH) principle are presented in more detail in the content of the SWZ. 8. SOURCES OF FINANCING: the subject contract is implemented within the project entitled „Purchase of diagnostic equipment for the development of AOS in the University Clinical Hospital named after F. Chopin in Rzeszow”, project no. FENX.06.01-IP.03-0064/25, implemented within the Programme European Funds for Infrastructure, Climate, Environment 2021–2027, Priority FENX.06 Health, Action FENX.06.01 Health protection system, based on the Grant Agreement no. FENX.06.01-IP.03-0064/25-00/83/2026/77 concluded between the State Treasury – Minister of Health, acting as the Intermediary Institution, and the University Clinical Hospital named after Fryderyk Chopin in Rzeszow. 9. The purchase of a computed tomography scanner and a digital mammography unit, including equipment and software, is financed from funds allocated for the implementation of the above-mentioned project, in accordance with the conditions of the Grant Agreement. The costs of adaptation works are borne by the Contracting Authority from its own funds, outside the project co-financing. 10. Implementation deadline: 1) Part 1 – purchase and delivery of computed tomography scanner – from the date of signing the contract to 29.12.2026; 2) Part 2 – purchase and delivery of digital mammography unit – from the date of signing the contract to 29.12.2026. 11. The execution of each part of the contract includes the implementation of all activities constituting the subject of the given part, within the scope specified in the SOD and the draft contractual provisions, including in particular the delivery of the device with equipment, transport, installation, performance of necessary adaptation works of the rooms, required for the correct installation, commissioning and use of the delivered device, installation, commissioning and conducting staff training.
