Poland – File servers – Dostawa serwerów wraz z oprogramowaniem (część I zamówienia) oraz dostawa oprogramowania serwerowego i bazodanowego (część II zamówienia)

1. The subject of the contract is the delivery of servers along with licenses. The subject of the contract has been divided into two parts: Part I – delivery of servers along with software Part II – delivery of server and database software. 2. Detailed information regarding the description, scope and conditions for the implementation of the subject of the contract are specified by: 1) In the scope of Part I of the contract – the "Subject of the Contract Description (SOCD)" being Annex 2A to the SWZ and the "Draft Contract Clauses, which will be introduced into the content of the concluded contract" being Annex 3A to the SWZ; 2) In the scope of Part II of the contract – the "Subject of the Contract Description (SOCD)" being Annex 2B to the SWZ and the "Draft Contract Clauses, which will be introduced into the content of the concluded contract" being Annex 3B to the SWZ. 3. The contracting authority informs that the offer submitted as part of the procedure may not include ICT products and ICT services indicated in the recommendations referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, nor ICT products or ICT services specified in decisions on the recognition of a supplier as a high-risk supplier, referred to in Article 67b(15) of the aforementioned Act. Detailed requirements in this regard are specified in the SOCD being Annex 2A to the SWZ (for Part I of the contract) and 2B to the SWZ (for Part II of the contract). An offer not meeting these requirements will be rejected under Article 226(1)(17) or (19) of the Act. 4. The contracting authority does not allow the possibility of submitting a variant offer, referred to in Article 92 of the Act, i.e. an offer providing for a different method of contract execution than that specified in this SWZ. 5. The contracting authority divides the contract into parts. Therefore, the contracting authority allows the submission of partial offers, referred to in Article 7(15) of the Act. 6. The contracting authority allows the submission of partial offers (Part I and II of the subject of the contract) for any chosen part of the subject of the contract (the contractor may submit an offer for two parts of the contract). 7. The contracting authority will evaluate the offers for each part of the subject of the contract separately. 8. The contracting authority reserves the right to select an offer for each part of the subject of the contract separately – the most advantageous offer from among the offers submitted for a given part of the contract will be selected based on the offer evaluation criteria specified in point 14 of the SWZ. 9. In the event of circumstances invalidating the procedure, the contracting authority will invalidate the procedure only in the given part. 10. The contracting authority does not envisage the awarding of contracts under Article 214(1)(7) and (8) of the Act. 11. It is not permissible for one Contractor to submit more than one offer for one part of the contract.
