Poland – Refuse and waste related services – Odbiór, transport i zagospodarowanie odpadów komunalnych w 2027 roku.

The subject of the contract is the collection, transport and disposal of municipal waste from the Contracting Authority's collection points located in the village of Krzyżówka, Radziejowice municipality, and in Żyrardów at ul. Czystej 5, from 01.01.2027 to 31.12.2027. The contract has been divided into 7 parts: a) Part I – collection, transport and disposal of non-segregated (mixed) municipal waste – code 20 03 01, in the amount from 2 000 Mg to 3 000 Mg; b) Part II – collection, transport and disposal of biodegradable waste – code 20 02 01, in the amount from 150 Mg to 300 Mg; c) Part III – collection, transport and disposal of packaging waste – paper and cardboard – code 15 01 01, in the amount from 20 Mg to 60 Mg; d) Part IV – collection, transport and disposal of mixed packaging waste – code 15 01 06, in the amount from 20 Mg to 60 Mg; e) Part V – collection, transport and disposal of bulky waste – code 20 03 07, in the amount from 50 Mg to 150 Mg; f) Part VI – collection, transport and disposal of mixed waste from concrete, brick rubble, waste ceramic materials and equipment elements other than those mentioned in 17 01 06 – code 17 01 07, in the amount from 50 Mg to 100 Mg; g) Part VII – collection, transport and disposal of waste from street and square cleaning – code 20 03 03, in the amount from 300 Mg to 1 200 Mg. The indicated quantities of waste are estimated. The lower limit of the range specifies the minimum scope of the contract, and the upper limit – the maximum scope of the contract in a given part. The actual amount of waste transferred will result from the current needs of the Contracting Authority, and the remuneration of the Contractor will be set as the product of the actual mass of collected and disposed waste and the unit price per 1 Mg. The Contractor is not entitled to any claims for non-performance of the contract in the scope exceeding the minimum scope.2. The detailed description of the subject of the contract contains the Description of the Subject of the Contract (OPZ), which is Annex No. 7 to SWZ. The detailed conditions for the implementation of the contract are specified in the contract template, common for all parts of the contract, which is Annex No. 6 to SWZ. The contract is concluded separately for each part of the contract – in the contract, only the position § 2 para. 4 regarding the given part is left, and the provisions marked „Applies only to Part I” (§ 3 para. 5, § 14 and § 15 of the contract template) are applied only in the contract for Part I.3. The Contractor is obliged to collect waste from the Contracting Authority's collection points: in the village of Krzyżówka, Radziejowice municipality – waste with codes 20 03 01, 20 02 01, 15 01 01, 15 01 06, 20 03 07 and 17 01 07, and in Żyrardów at ul. Czystej 5 – waste with code 20 03 03. Collection will take place from Monday to Friday from 7:00–14:00 (excluding legally non-working days), after prior notification of demand by the Contracting Authority by telephone or email: in the case of notification by 10:00 – by 14:00 of the next working day, and in the case of notification after 10:00 – by 14:00 of the second working day following the day of notification. Waste loading is carried out using the means and at the expense of the Contracting Authority; the Contractor's vehicle is weighed before and after loading on the Contracting Authority's legalised weight, and the transport is registered in the BDO.4. The Contractor is obliged to ensure the disposal of waste in a facility (facilities) with current, legally required permits, in a manner enabling the achievement of the levels of preparation for reuse and recycling specified in § 4 para. 6 of the contract template and not exceeding the level of disposal specified in § 4 para. 7 of the contract template. In Part I, non-segregated (mixed) municipal waste must be processed in a municipal facility entered on the list referred to in art. 38b para. 1 point 1 of the Act of 14 December 2012 on waste. The Contractor indicates in the Offer Form the facility (facilities) in which the waste of the given part of the contract will be disposed of. In the event of a failure of the facility or other reasons preventing the acceptance of waste, the Contractor acts in accordance with § 4 para. 16 of the contract template.5. In Part I, the Contractor is additionally obliged, no later than 3 days from the date of conclusion of the contract, to equip the Contracting Authority with two containers with a capacity of 36 m³ for waste collection and to ensure transport adapted to their removal in a rotational manner, necessary to maintain the continuity of service provision. (§ 3 para. 5 of the contract template) In Part I, the Contractor is also obliged to provide a guarantee of proper performance of the contract and to have civil liability insurance in the amount of the guarantee not less than 500 000,00 zł (§ 14 and § 15 of the contract template). 6. The Contractor is obliged to provide the Contracting Authority with monthly reports on the service performed for all waste codes, and for waste with codes 20 03 01, 20 02 01, 15 01 01, 15 01 06 and 20 03 07 additionally half-yearly and annual reports.
