Description
1. THE SUBJECT OF THE CONTRACT is the equipping of Hospital Departments, the Operating Block and the Sterilisation, Disinfection and Cleanliness Maintenance Department through the supply of medical devices and other equipment. 2. The subject of the contract is detailed in Attachment No. 1 to SWZ - FO, in Attachments No. 2.1 to 2.4 to SWZ – List of required quality-technical parameters and in Attachment No. 5 to SWZ – PPU, in which the quantity of the subject of the contract and the OPZ are given. 3. The contract is co-financed: a. Package No. 1 under the agreement DZ-IV-A/55/2026 concluded between WSZ in Konin and Woj. Wielkopolskim for the grant of a subsidy for the equipping of the Neurochirurgical Department together with the operating room; b. Package No. 2 under the agreement No. DZ-IV-A/66/2026 concluded between WSZ in Konin and Woj. Wielkopolskim for the grant of a subsidy for the purchase of a hysteroscopy set for the needs of the Gynaecological-Obstetric Department; c. Packages No. 3-4 under the agreement No. DZ-IV-A/33/2026 concluded between WSZ in Konin and Woj. Wielkopolskim for the grant of a subsidy for the equipping of the Central Sterilisation Unit through the purchase of a steam steriliser together with an instrument washer (disinfector). 4. The contract allows for the possibility of submitting partial offers. The subject of the contract has been divided into parts (packages). 5. The contract allows for the submission of an offer for one, several or all parts. 6. The subject of the contract will be delivered at the cost, risk and transport of the Contractor. 7. The conditions for the implementation of the subject of the contract are also included in the PPU, which are Attachment No. 5 to SWZ. 8. The minimum guaranteed level of the value of the contract, to which the Contracting Authority commits, amounts to: 100% of the value of the contract. 9. The contract does not allow for the submission of alternative offers. 10. In the event that, in the OPZ, reference is made to the indication of trade marks, patents or origin, source or a special process, which characterises the products or services supplied by a specific contractor, this should be understood to mean that each time such an indication is accompanied by the expression "or equivalent". 11. Under the term "or equivalent" the Contracting Authority understands the offering of materials guaranteeing the implementation of the task in accordance with the requirements of the Contracting Authority and ensuring the achievement of technical parameters not worse than those set out in the SWZ. The application of equivalent solutions should not lead to a deterioration of the properties of the subject of the contract in relation to those envisaged in the original documentation, nor to a change in price, nor to a breach of the law. 12. Any product names or manufacturers mentioned in the OPZ are used solely for the purpose of example, i.e. to illustrate the requirements which could not be described using sufficiently precise and understandable terms. Any product names and their manufacturers mentioned do not aim to infringe the principle of fair competition and equal treatment of contractors. Where they are mentioned, they should be read as being accompanied by the term "or equivalent". 13. At the same time, the requirements must be met in terms of: - dimensions and construction (size, type, physical properties and number of components); - functional nature (identity of function); - technical parameters (strength, durability, technical data, construction); - user safety parameters; - emission standards. The above requirements constitute the criteria for equivalence. 14. The contract allows for the supply of equivalent products or equipment in relation to the OPZ, i.e. the offered subject of the contract will have the same or higher technical, qualitative, functional and user parameters as those indicated in the OPZ. 15. The trade marks, brand names, etc. indicated in the OPZ (if any) – constitute an exclusive quality pattern for the subject of the contract. In all cases where, due to the specific subject of the contract, product, equipment or material names are indicated, the use of equivalent products, equipment or materials is allowed, i.e. all the materials mentioned by name used in the description of the subject of the contract serve exclusively to define the standard and may be replaced by others with no worse user and qualitative parameters. The Contracting Authority will verify offers containing equivalent solutions in terms of compliance with the requirements of the individual technical specifications contained in the attachments to the SWZ. The contractor is obliged to prove in the offer the equivalence of the offered assortment. The burden of proving equivalence is the obligation of the contractor. The Contracting Authority will not accept equivalent solutions if they are worse than those indicated in the attachments to the SWZ minimum quality requirements. 16. Pursuant to Article 101(5) of the Pzp Act: in the event that the OPZ refers to standards, technical assessments, technical specifications and technical reference systems, as referred to in Article 101(1)(2) and (3) of the Pzp Act, the Contracting Authority may not reject an offer solely on the grounds that the works, supplies or services offered are not in conformity with the standards, technical assessments, technical specifications and technical reference systems to which the OPZ refers, provided that the contractor proves in the offer, in particular by means of the evidence referred to in Articles 104-107 of the Pzp Act, that the proposed solution meets the requirements set out in the OPZ to an equivalent extent. 17. Pursuant to Article 101(6) of the Pzp Act: in the event that the OPZ refers to requirements relating to performance or functionality, as referred to in Article 101(1)(1) of the Pzp Act, the Contracting Authority may not reject an offer in conformity with the Polish Standard transposing the European Standard, with the standards of other Member States of the EOG transposing the European Standards, with the European Technical Assessment, with the common technical specification, with the international standard or with the technical reference system established by the European standardisation body, if those standards, technical assessments, specifications and technical reference systems relate to the requirements relating to the performance or functionality defined by the Contracting Authority, provided that the contractor proves in the offer, in particular by means of the evidence referred to in Articles 104-107 of the Pzp Act, that the works, supplies or services comply with the requirements relating to performance or functionality defined by the Contracting Authority. Any product names and their manufacturers mentioned are used solely for the purpose of illustrating the requirements which could not be described using sufficiently precise and understandable terms.
