Poland – Refuse and waste related services – Świadczenie usługi obejmującej zagospodarowanie odpadów komunalnych pochodzących z terenu Miasta Łaziska Górne w 2027 r.

The subject of the contract is the provision of a service covering the management of municipal waste originating from the area of the City of Łaziska Górne in 2027. The subject of the contract has been divided into 3 parts:

Part 1 - The subject of the contract is the provision of a service covering the management of municipal waste originating from the area of the City of Łaziska Górne in 2027 from inhabited properties and waste collected as part of the Selective Waste Collection Point PSZOK (hereinafter PSZOK) for the following waste codes: 20 03 01, 15 01 01, 20 01 01, 15 01 02, 15 01 04, 15 01 05, 15 01 06, 20 01 39, 20 01 40, 15 01 07, 20 01 02, 20 01 08, 20 02 01, ex 20 01 99 - ash from domestic incinerators, 20 03 07, 15 01 10*, 20 01 10, 20 01 11, 20 01 13*, 20 01 19*, 20 03 07, 20 01 21*, 20 01 23*, 20 01 25, 20 01 26*, 20 01 28, 20 01 30, 20 01 32, 20 01 34, 20 01 35*, 20 01 36, 20 01 99 - waste not qualifying as medical waste generated in the household as a result of taking medicinal products in the form of injections and monitoring the level of substances in the blood, in particular needles and syringes, 16 01 03. The waste to be managed will be handed over successively in quantities depending on the amount of waste generated by the residents of the City of Łaziska Górne and depending on the frequency of filling containers/ bins located in the PSZOK. The estimated mass of waste to be managed is 7 947.50 Mg. Implementation period: 12 months from the date of conclusion of the contract, but not earlier than 1 January 2027 and not later than 31 December 2027.

Part 2 - The subject of the contract is the provision of a service covering the management of municipal waste, i.e. 20 02 01 - biodegradable waste collected as part of the Selective Waste Collection Point PSZOK (hereinafter PSZOK) located in the City of Łaziska Górne. The waste to be managed will be handed over successively in quantities depending on the frequency of filling containers/ bins located in the PSZOK. The estimated mass of waste to be managed is 1 500.00 Mg. Implementation period: 12 months from the date of conclusion of the contract, but not earlier than 1 January 2027 and not later than 31 December 2027.

Part 3 - The subject of the contract is the provision of a service covering the management of construction and demolition waste from households with the following codes: 17 01 01, 17 01 07, 17 06 04, 17 09 04, collected as part of the Selective Waste Collection Point PSZOK, located in the City of Łaziska Górne. The waste to be managed will be handed over successively in quantities depending on the frequency of filling containers/ bins located in the PSZOK. The estimated mass of waste to be managed is 900.00 Mg. Implementation period: 12 months from the date of conclusion of the contract, but not earlier than 1 January 2027 and not later than 31 December 2027.

Pursuant to Article 214(1)(7) of the Public Procurement Law (Pzp), the contracting authority envisages the repetition of similar services as for the basic contract, consistent with the subject of the basic contract, consisting in the provision of a service covering the management of municipal waste originating from the area of the City of Łaziska Górne in 2027, constituting part of the contract (scope of the contract). The contracting authority envisages the possibility of awarding contracts, as referred to in Article 214(1)(7) of the Pzp, constituting no more than 10% of the value of the basic contract, consisting in increasing the amount of municipal waste designated for management, specified for the basic contract in the Description of the Subject of the Contract. The repetition of similar services may concern one or several or all types of waste covered by the basic contract, depending on the needs. In Part 1 - the contract for the repetition of similar services will not exceed 794.75 Mg, in Part 2 - will not exceed 150.00 Mg, in Part 3 - will not exceed 90.00 Mg. The provision of services consisting in the repetition of similar services is envisaged when the contracting authority does not have a signed contract or the signed contract has been exhausted or in the case of an extended procedure for awarding a contract for the year 2028. Conditions for awarding the contract, in Article 214(1)(7) of the Pzp: unit prices resulting from the offer for the basic contract for individual waste codes. Contractors may jointly apply for the award of the contract. In this case, they appoint a representative to represent them in the contract award procedure or to represent them in the procedure and conclude a contract in the matter of public procurement. Contractors jointly applying for the award of the contract are obliged to submit together with the offer an appropriate power of attorney – in accordance with point 10.2.1 – this does not apply to a civil law partnership, unless the authorisation/power of attorney to act on behalf of this partnership results from the partnership agreement attached to the offer or all partners sign the offer. The condition regarding the entitlements to conduct a specific economic or professional activity, referred to in Article 112(2)(2) of the Pzp, and in point 9.1.2 of the SWZ, will be met if at least one of the Contractors jointly applying for the award of the contract has the entitlements to conduct a specific economic or professional
