The subject of the order are successive deliveries of medicines and medical products in the assortments and quantities given in the price list constituting Annex 2 to the SWZ and in accordance with the planned provisions of the contract constituting Annex 4 to this SWZ. The ordering party has specified in Annex 2 to the SWZ the quality requirements relating to at least the main elements constituting the subject of the order. The ordering party guarantees that the minimum value of deliveries during the period of validity of the contract in the basic scope will be 75% of the maximum value of the contract in the basic scope specified in § 5 of the contract for the given task. - does not apply to tasks 3-6, 31; the term "basic scope" applies to tasks 18, 26. The goods offered by the Contractor that are the subject of the order must be approved for sale and use in Poland or must have a one-time permit from the Ministry of Health. The Contractor must offer and price all the assortment items listed in the price list. The Contractor should provide the trade name of the offered goods and the EAN code in the price list. The prices of the offered products must not exceed the limits of their refunds announced in the announcements of the Minister of Health regarding the list of refunded medicines, special dietary foods and medical products. - applies to positions listed in the list of refunded medicines. In the event of a drug being removed from the list of refunded drugs or in the event of its production being discontinued, the permit to be placed on the market expiring, the drug being suspended or withdrawn from the market, the Contractor will be obliged to offer the ordering party a drug with the same international name (if available), dosage, form, indications, which is on the list of refunded drugs, at the lowest price among the remaining drugs, provided that this price does not exceed the refund limit, with the reservation of § 6 para. 3 point 5 of Annex 4 to the SWZ. - applies to positions listed in the list of refunded medicines. The ordering party informs that in the subject proceedings conducted in the open procedure, the possibility of applying the procedure referred to in Article 139(1) of the p.z.p. Act is envisaged. The ordering party, when applying the mentioned procedure, will first carry out an examination and evaluation of the offers, and then carry out the qualification of the Contractor, whose offer was the highest evaluated in terms of lack of grounds for exclusion and meeting the conditions for participation in the proceedings.
