The subject of the Contract is the supply of a shunting locomotive. 2. The scope of the contract includes the delivery of a two-axle diesel shunting locomotive (hereinafter: locomotive) with a maximum speed of up to 40 km/h, intended for light shunting work on the entire metro infrastructure and for the transport of metro rail vehicles on tracks with a gauge of 1435 mm. 3. The locomotive must be adapted for operation with metro vehicles used by the Contracting Authority: vehicles of the Varsovia, Inspiro, Metropolis 98B, series 81 types, as well as 208 Kg/M cover wagons. Additionally, it must have the capability to work in double traction (multiple control) with the LM-400 locomotive and the 794 type locomotive. The technical requirements for the locomotive have been specified by the Contracting Authority in the Technical Specification together with the annexes (hereinafter: "TS"), which constitutes a description of the Subject of the Contract and is an integral part of this SWZ, including Annex 1 to the TS, i.e. the document entitled "Parameters and technical requirements of the locomotive". 4. The Subject of the Contract is to be implemented in three stages with the scopes indicated in the TS. As part of the implementation of the Subject of the Contract, the Contractor will prepare complete and comprehensive technical documentation containing all technical descriptions of the assemblies and subassemblies of the delivered locomotive, as well as operational documentation, containing a list of catalogue numbers of parts, assemblies and subassemblies. The documentation should be prepared in Polish and take into account the technical requirements specified in Annex 1 to the TS. Furthermore, the Contractor, within a timeframe agreed with the Contracting Authority, prior to the deadline for the locomotive to be commissioned, will conduct at its own cost training on the operation and maintenance of the locomotive. The conditions of the training are specified in Section 3.11 of the TS. 5. In the event that the Subject of the Contract is executed using solutions equivalent to the standards indicated by the Contracting Authority in the TS and its annexes, the Contractor is obliged to prove that the proposed solutions meet the requirements specified in the description of the Subject of the Contract to an equivalent extent. To this end, the Contractor is obliged to submit with the offer: 1) a declaration (on the Contractor's own letterhead), in which the Contractor is obliged to: declare that it will execute the Subject of the Contract using solutions equivalent to the standards indicated by the Contracting Authority in the TS, indicate the scope of the standards indicated by the Contracting Authority in the TS and its annexes in which the Contractor will execute the Subject of the Contract using solutions equivalent to the above standards and indicate the proposed solutions equivalent to the above standards, 2) the evidential means referred to in Section 12 of the SWZ. If the Contractor does not submit the above declaration with the offer regarding the execution of the Subject of the Contract using solutions equivalent to the standards indicated by the Contracting Authority in the TS, the Contracting Authority will consider that the Contractor is offering to execute the Subject of the Contract in accordance with the standards indicated in the TS. 6. The Subject of the Contract will be implemented in accordance with the procedural documentation, i.e.: this SWZ and its annexes, in particular the TS together with the annexes (Annex 1 to the SWZ) and the Contract Template (Annex 2 to the SWZ).
