Germany – Social work and related services – Vorläufige Unterbringung und Betreuung von Geflüchteten in der GU David-Gilly-Str. 5 und dem WV Peter-Huchel-Str. 4, 14469 Potsdam (Los 1) und in der GU Handelshof 20, 14478 Potsdam (Los 2)

1. Preliminary remarks

According to the Law on the Reception of Refugees, Late Resettlers and Other Persons Migrating from Abroad in the State of Brandenburg and on the Implementation of the Asylum Seekers' Benefits Act (State Reception Law - LAufnG), the reception, provisional accommodation and migration-specific social support of the groups of persons mentioned in § 4 LAufnG, as well as the implementation of the Asylum Seekers' Benefits Act, are public tasks that are assigned to the districts and independent cities as mandatory tasks to be fulfilled upon instruction. The framework conditions for this are regulated in the Ordinance on the Implementation of the State Reception Law (State Reception Law Implementation Ordinance - LAufnGDV) and the Ordinance on Cost Reimbursement under the State Reception Law for the Reception of Refugees, Late Resettlers and Other Persons Migrating from Abroad (State Reception Law Reimbursement Ordinance - LAufnGErstV). The State Capital of Potsdam (LHP) intends to commission an external contractor (AN) with the services described below for the performance of its mandatory tasks of provisional accommodation on the basis of § 10 Paragraph 2 LAufnG and general social care on the basis of § 12 Paragraph 2 LAufnG. 2. Groups of persons

The present contract for accommodation and care mainly relates to the group of persons according to § 4 LAufnG. In addition, the LHP may assign persons from other relevant groups to the accommodation in individual cases. 3. Description of the accommodation

For a detailed description of the accommodations for Lot 1 and Lot 2, reference is made to the lot-specific information and the service description for Lot 1 and Lot 2. 4. Scope of services

The LHP expects the AN to take over and fulfill the organization and implementation of the provisional accommodation and migration-specific social care at the locations David-Gilly-Str. 5 and Peter-Huchel-Str. 4 in 14469 Potsdam (Lot 1) and at the location Handelshof 20 in 14478 Potsdam (Lot 2) (hereinafter referred to as accommodation) from 01.01.2027 on the basis of the service modules presented below. The provision of services in accordance with this service description represents the minimum requirement. The bidders have the possibility to make additional service commitments in the framework of the offer, corresponding to the evaluation matrix for additional service quality, which is part of the tender documents. These additional service commitments must be recorded in a separate quality concept, which is a binding part of the offer and must be attached to the tender documents. Bidders must orient themselves to the evaluation matrix for evaluating service quality when committing to additional service quality in a quality concept. Only then can the additionally offered service quality be taken into account within the framework of the evaluation of the quality of the offers. Statements in the quality concept that do not indicate a binding provision of services will not be taken into account in the evaluation of the additional service quality. 4.1 Service module Accommodation

A detailed description of the above-mentioned service module is not possible due to limited presentation possibilities. Therefore, the relevant contents are to be taken from the respective service description for Lot 1 and Lot 2. 4.2 Service module Security services a.) The accommodation must be protected by the AN from the outside and inside by suitable organizational measures against unauthorized access, vandalism, attacks and conflict situations as well as against fire, accident and severe weather. Statements must be made about this in a police-approved security concept. The AN is responsible for the creation, implementation and updating of the police-approved security concept for the entire accommodation and bears the costs incurred in this regard. The police-approved security concept must clearly specify the scope of the necessary guarding of the buildings of the accommodation and must be submitted to the LHP within 3 months after the start of operations. b.) The AN must ensure that the buildings of the accommodation are occupied by suitable security personnel in accordance with the police-approved security concept. Only security personnel who meet the requirements of § 34a of the Trade Regulations and § 72a of the Social Code (SGB) - Eighth Book (VIII) Paragraph 1 Sentence 1 are considered suitable. A corresponding confirmation of the use of suitable security personnel must be submitted by the AN at the start of the contract and annually by 31.03. The AN must provide the LHP with written proof of the suitability of the actually deployed security personnel upon first request. The AN undertakes to use exclusively security personnel for the fulfillment of the contract, which meets the requirements of § 34a Paragraph 1a of the Trade Regulations and the Security Guarding Ordinance (BewachV) for security guards. In particular, only security guards who are registered in the security guard register and have been finally tested for reliability may be used. All deployed security guards must have a certificate from the Chamber of Industry and Commerce (IHK) or an equivalent, officially recognized proof that they have been informed about the legal and technical basics necessary for the exercise of the trade. At least one of the security guards deployed at any one time must additionally have a certificate of competence from the IHK or an equivalent, officially recognized proof. Each security guard who is active in a leading position in the accommodation must wear a badge with their name or an identification number as well as the designation of the trade during their activity. Alternatively, the service ID may be worn visibly.
