Description
The subject of the contract is the comprehensive design and construction of a pedestrian and cycle path in the Municipality of Zakroczym, including a section of the pedestrian path, bicycle parking, lighting, signage, small architectural elements, land development, and all works and activities necessary to obtain a complete, safe, and ready-to-use facility. 2. The contract in the Municipality of Zakroczym is for the implementation of the joint investment project entitled „Urban Mobility Development in Nowy Dwór County”, within the framework of the European Funds for Mazovia 2021-2027 – within Priority III „European Funds for Urban Mobility Development in Mazovia” – Action 3.2 „Urban Mobility within ZIT” – Project Type: „Bicycle and Pedestrian Infrastructure” co-financed from the European Regional Development Fund, within the partnership agreement concluded between Nowy Dwór County, Pomiechówek Municipality, Zakroczym Municipality, Nowy Dwór Mazowiecki City and Nasielsk Municipality. 3. The detailed description is specified in Annex No. 2 to SWZ entitled PFU prepared for tasks implemented throughout the Municipality of Zakroczym and Annex No. 3 to SWZ OPZ prepared based on PFU for the task implemented only by the Municipality of Zakroczym. 4. The detailed scope and manner of performing the subject of the contract have been specified in the Draft Contract Terms - Annex No. 1 to SWZ. 5. The scope of the contract includes in particular: 1) conducting a field survey, geodetic measurements, inventory and necessary subsoil investigations; 2) obtaining a map for design purposes and data from the geodetic resource; 3) developing a concept and complete multi-disciplinary design documentation; 4) obtaining all necessary agreements, opinions, technical conditions, consents, decisions and permits; 5) developing and approving temporary and permanent traffic organization; 6) performing author's supervision throughout the construction period; 7) performing preparatory, demolition and earthworks; 8) constructing the pedestrian and cycle path, pedestrian path and bicycle parking; 9) constructing edges, curbs, drainage elements and land protection; 10) building cable lighting in LED technology with power supply, control, grounding and measurements; 11) performing vertical and horizontal signage and traffic safety devices, if required; 12) supplying and installing bicycle repair stations, „U” type inverted stands and a rest shelter; 13) restoring adjacent lands, humus application, sowing and land arrangement; 14) performing tests, documentation and post-construction geodetic inventory; 15) obtaining on behalf of the Contracting Authority documents enabling the legal use of the facility, if required; 16) and temporary and accompanying works, supplies, services, fees, agreements and activities, the necessity of which can be foreseen on the basis of PFU, annexes, local vision, professional knowledge and applicable regulations, even if not listed separately. 6. The investment will be implemented in the administrative area of the Mazowieckie Voivodeship, in Nowy Dwór County, in the Municipality of Zakroczym, on land parcel no. 10/18 within 0008 Poligon, adjacent to a road owned by the Municipality of Zakroczym. 7. The Contracting Authority requires the Contractor or Subcontractor to employ people based on an employment relationship to perform tasks directly related to the execution of the contract, i.e., workers performing tasks involving physical work, operating equipment and tools during the construction works. 8. The required warranty period for the prepared design documentation, completed construction works, supplied and built-in materials and supplied and built-in equipment by the Contractor is at least 5 years from the date of signing the final acceptance protocol without reservations. The Contractor will provide a warranty for defects for a period not shorter than the warranty period. An offer of an extended warranty period beyond the required period will be additionally scored, according to SWZ. 9. The implementation of the subject of the contract is subject to Polish law, including in particular the Act of 7 July 1994 on Construction Law and the Act of 11 September 2019 on Public Procurement. 10. The Contractor is responsible for the proper preparation of the design documentation and for the quality of the performed works and materials used. 11. The works must be performed in accordance with applicable regulations (in particular the Construction Law Act, occupational health and safety and fire protection regulations and industry-specific regulations), as well as in accordance with technical knowledge, with due diligence, proper organisation of work and ensuring good quality. 12. The materials used by the Contractor during the implementation of the subject of the contract should be factory new and meet, in terms of quality, the requirements of products approved for sale and use in construction, in accordance with Article 10 of the Construction Law Act and the qualitative and type requirements specified in OPZ and the Technical Specification for the Execution and Acceptance of Construction Works. The Contractor shall submit to the Contracting Authority documents confirming the requirements before their installation, under penalty of an order to dismantle the completed works and demolition of the installed materials at the Contractor's expense. 13. All materials, products and equipment used must have current documents (certificates, approvals and declarations of conformity) allowing their use in construction, in accordance with the regulations in force in this respect. 14. The Contractor is obliged to implement the contract within a maximum of 13 months from the date of conclusion of the contract, including the completion of design works within a maximum of 8 months from the date of conclusion of the contract. 15. The subject of the Contract is implemented in two stages: 1) Stage I – preparation of design documentation, 2) Stage II – execution of construction works.
