Poland – Refuse and waste related services – Odbieranie odpadów komunalnych od właścicieli nieruchomości położonych w sektorach od I do V na terenie Gminy Miejskiej Kraków i ich transport do instalacji przetwarzania odpadów oraz zagospodarowanie wybranych odpadów

The subject of the Contract involves the provision of services for the collection of municipal waste from property owners located in sectors I to V within the Municipality of Kraków, as well as - the transport of waste to municipal waste processing facilities, - the management of bio-waste generated in catering establishments, hotels, commercial facilities, kindergartens, nurseries, schools, care facilities, collective catering units, canteens, etc., as well as bio-waste generated by other producers, including in households, - the management of no more than a strictly defined quantity of unsorted (mixed) municipal waste, as well as ancillary services, i.e. services other than those related to the collection or management of municipal waste. A detailed description of the subject of the contract (hereinafter referred to as the "Contract Subject"), including all Tasks and ancillary services, is contained in Annex No. 1 to the SWZ – Description of the Subject of the Contract (hereinafter referred to as the "PSC"). In accordance with Article 6d(3) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2025, item 733, hereinafter referred to as the "ucpg"), the public contract is awarded separately for 5 Tasks related to individual sectors, in accordance with Resolution No. LXXI/1044/13 of the City Council of Kraków of 10 April 2013 on the division of the area of the Municipality of Kraków into sectors for the purpose of organising the collection of municipal waste from property owners and the designation of points for the selective collection of municipal waste (hereinafter referred to as "Resolution No. LXXI/1044/13"). a) Task No. 1 covering Sector I designated by the area of Districts I, II, III, XIV, b) Task No. 2 covering Sector II designated by the area of Districts IV, V, VI, VII, c) Task No. 3 covering Sector III designated by the area of Districts VIII, IX, X, d) Task No. 4 covering Sector IV designated by the area of Districts XI, XII, XIII, e) Task No. 5 covering Sector V designated by the area of Districts XV, XVI, XVII, XVIII. The Contracting Authority allows for the submission of partial tenders, i.e. tenders for Tasks (Sectors) No. 1, 2, 3, 4 or 5 in accordance with Resolution No. LXXI/1044/13. The Contracting Authority limits the number of Tasks (Sectors) for which a Contractor may submit a tender to 3 (three) Tasks (Sectors). The Contractor may therefore submit a tender for one, two or three Tasks (Sectors). The Contracting Authority thereby limits the number of Tasks (Sectors) that can be awarded to one Contractor to 3 (three) Tasks (Sectors). For example, if a Contractor is a member of 3 (three) consortia and as a consortium submits a tender for 3 (three) different Tasks (Sectors), then the submission of a tender for a fourth Task (Sector) will result in the rejection of all tenders involving that Contractor.
