Poland – Portable computers – Dostawa komputerów przenośnych wraz z akcesoriami dla jednostek organizacyjnych Uniwersytetu Gdańskiego z prawem opcji, w podziale na części od I do VIII

The subject of the contract is the delivery of portable computers, hereinafter referred to as „equipment”, along with accessories, for the organisational units of the University of Gdańsk, with the right of option, divided into eight parts: Part I - Delivery of a portable computer (type B6) along with accessories for the Faculty of Mathematics, Physics and Informatics. Part II: Delivery of a portable computer (type B3) for the Faculty of Oceanography and Geography. Part III: Delivery of portable computers (type A) for the Interfaculty Faculty of Biotechnology UG and GUMed. Part IV: Delivery of a portable computer (type B2) for the Central Administration. Part V: Delivery of a portable computer (type B2) for the Faculty of Social Sciences. Part VI: Delivery of a portable computer (type B5) along with accessories for the Faculty of Chemistry. Part VII: Delivery of a portable computer (type B6) along with accessories for the Faculty of Oceanography and Geography. Part VIII: Delivery of portable computers (type A) for the Faculty of History. 2. Classification of Products and Services (CPV) Code: 30213100-6 (portable computers), 30237200-1 (computer accessories) - accordingly for parts I - VIII. 3. The contract includes the delivery of portable computers along with accessories in the quantities specified in the tender form – Annex 1 to the SWZ, accordingly for parts I - VIII. 3. The Purchaser has the right to exercise the option, which involves increasing the quantity of equipment ordered under the main contract, on the terms and in the manner described below: 1) The Purchaser may, within 14 days from the date of conclusion of the contract, submit to the Contractor the order covered by the option, specifying the quantity and type of equipment indicated in the tender form – Annex 1 to the contract, with the proviso of not exceeding the maximum scope of the option specified in this annex, 2) submission to the Contractor of the order covered by the option by the Authorised Representative of the Purchaser, as referred to in § 12(1)(2)(c), in the manner specified in § 6(5) of the contract draft – Annex 5 to the SWZ, constitutes the Purchaser's exercise of the option in terms of the quantity and type of equipment specified in this order, 3) The Purchaser may exercise the option once or several times, by submitting consecutive orders covering selected quantities and types of equipment, until the maximum scope of the option specified in the tender form – Annex 1 to the contract is exhausted, but no later than the deadline referred to in point 1, 4) the value of the equipment ordered under the option will be in accordance with the unit prices indicated by the Contractor in the tender form – Annex 1 to the contract, 5) the implementation period of each order covered by the option may not be longer than that specified in § 2(2), 6) exercising the option does not constitute a change to the contract. The Contractor has no claim against the Purchaser for the Purchaser's failure to exercise the option in whole or in part. The decision to exercise the option, including its scope, is the sole right of the Purchaser, 7) the provisions of the contract relating to the main order shall apply accordingly to orders covered by the option, unless the contract provides otherwise. 4. A detailed description of the subject of the contract is specified in Annex 6 to the SWZ – description of the subject of the contract, accordingly for parts I - VIII. 5. The delivery locations for the equipment for each part are specified in Annex 7 to the SWZ. 6. Details regarding the warranty are included in § 7 of the contract draft – Annex 5 to the SWZ. 7. In the description of the subject of the contract, which is Annex 6 to the SWZ, the Purchaser described the requirements relating to management systems concerning the production process of the offered equipment by reference to the standards indicated in Table 1 of the description of the subject of the contract: in position 6(2) for parts I, II, IV, V, VI, VII and in position 4(2) for parts III, VIII. In each case where these standards have been indicated in the text of the SWZ, including in the annexes to the SWZ, it should be understood that such an indication is accompanied by the words „or equivalent”. Thus, the Purchaser allows for equivalent solutions in relation to the standards indicated in the above-mentioned positions of Table 1 of the description of the subject of the contract, in accordance with Article 101(4) and (5) of the Pzp. The concept of equivalence should be understood to mean that the offered equipment comes from production covered by an implemented and current management system, which meets the requirements specified in position 6(2) for parts I, II, IV, V, VI, VII and in position 4(2) for parts III, VIII of Table 1 of the description of the subject of the contract to an equivalent extent. The applied equivalent solutions must correspond in kind and scope to the purposes served by the standards invoked in the above-mentioned positions of Table 1 of the description of the subject of the contract. 8. Due to the fact that the possibility of various equivalent proposals has been allowed, the Contractor is required to verify and treat all solutions as interrelated. The demonstration of equivalence, i.e. the fulfilment to an equivalent extent of the requirements specified by the Purchaser in the description of the subject of the contract, lies with the Contractor. In the case of offering equipment from production covered by a management system in accordance with an equivalent standard or another equivalent solution in relation to the standards indicated in Table 1 of the description of the subject of the contract in position 6(2) for parts I, II, IV, V, VI, VII, in position 4(2) for parts III, VIII, the Contractor is obliged to indicate this solution in point 5 of the tender form, which is Annex 1 to the SWZ – accordingly for parts I-VIII, to present information about the offered equivalent solution, justification for its equivalence and evidence confirming the equivalence.
