The subject of the contract is the provision of a multi-sectoral investment supervision service for construction works related to the contract being realized in the "design and build" system, the scope of which has been detailed in paragraph 2.

2. The subject of the contract, for which investment supervision will be conducted, includes the construction of a covered swimming pool building and a freestanding gas boiler building with land development and necessary technical infrastructure (Phase I) and the demolition of the existing covered swimming pool building along with the construction of a parking lot (Phase II). The location of the task - Pabianice, ul. gen. Stefana Grota Roweckiego / Jana Kilińskiego (land register no. 216/6, 216/7, 217 plot P-13):

a) preparation of design documentation and specifications,

b) execution of construction and installation works along with obtaining the necessary documents (e.g., protocols, agreements, permits, approvals) enabling the handover of the facility for use in accordance with applicable regulations and standards in construction.

3. The contractor, taking into account the scope of the contract, must ensure the participation of sectoral inspection supervisors possessing the appropriate authorizations in the number and time frame necessary for the proper execution of the contract.

4. Additional information regarding the construction works, for which the subject of the contract will be realized, covered by the subject of the procedure:

a) The gross value of the construction and installation works (including the preparation of design documentation), for which investment supervision is concerned, has been set at the amount of 94,759,053.94 PLN (based on the value of the most favorable offer, which was selected in the procedure for the realization of the construction works).

b) The scope of the works performed by the contractor is specifically defined by: the functional-user program, guidelines for technical and executive projects in terms of detailed execution, finishing and equipment of the facility, architectural and construction projects as well as PZT, for which the Contracting Authority obtained a legally binding building permit no. 650/2025 of 07.11.2025. 5. As part of performing the functions of a supervision inspector, the basic obligations include, in particular:

a) performing the obligations assigned to the Investment Supervision, as contained in the contract for the realization of construction works in the "design and build" system (Annex no. 9 to swz);

b) carrying out, on behalf of the Contracting Authority, a detailed assessment and verification of the design documentation provided by the Contractor (technical project prepared at the level of detail of the executive project and technical specifications for the execution and acceptance of construction works), in particular with regard to its compliance with the Functional-User Program (PFU), architectural and construction projects as well as PZT (for which the Contracting Authority obtained a legally binding building permit), technical conditions as well as applicable legal regulations and standards, concluded with the issuance of a written opinion, remarks or recommendations for the scope of the received design documentation within 7 working days from the date of its receipt from the Contracting Authority or the Contractor - in the event of detecting errors, defects or inconsistencies in the documentation with the source documents, the supervision inspector will prepare and submit to the Contracting Authority a list of remarks along with a technical or legal justification, and after the Contractor makes corrections to the works, the supervision inspector will carry out a re-verification of the corrected documentation within 3 working days from the date of its re-submission;

c) supervision of the execution of the works and their financing in accordance with the work schedule;

d) participation in construction councils, technical and problem-solving meetings and other meetings organized by all parties to the investment process (in particular those convened at the initiative of the representative of the Contracting Authority);

e) keeping documentation related to the implementation of the project, preparing correspondence projects related to the conducted works on behalf of the administration and control bodies;

f) initiating or commenting on proposals for changes to the contract, or the realization of additional works (art. 214 sec. 1 point 7 of the Pzp Act), including the verification of the necessity of their execution, compliance with legal regulations, preparation of the necessary documentation. In the same scope, the Contractor will be obliged in the event of the need to apply alternative solutions and materials, or in the event of the detection of defects in the design documentation.

g) undertaking all actions enabling the proper execution of the works;

h) conducting technical supervision over the execution of the works in accordance with the Building Law;

i) performing coordination functions on the construction site;

j) managing a team of sectoral supervision inspectors;

k) constant consultation and expert advice for the Contracting Authority;

l) timely preparation of documents necessary for settlements with the contractor of construction works, including the preparation of settlement documents, reports and other documents required for the execution of the works, cooperation in this scope with the Investor, designer and contractor of construction works;

m) undertaking all necessary actions to protect the interests of the Investor;

n) during the 1 year period from the final acceptance of the construction works, supporting the actions of the Contracting Authority aimed at fulfilling the obligations of the Contractor of construction works resulting from the warranty and guarantee by: supporting the Contracting Authority in the process of reporting any defects and faults, supervising the actions of the Contractor of construction works aimed at eliminating the reported faults, participation in the acceptance of remedial works, participation in two inspections.
