Description

The subject of the contract is the modernisation of the cooling system of the left cooling circuit's chiller in BST by replacing the ventilated cooler (drycooler). 2. The scope of the contract also includes the design of the device's foundation, the dismantling of the existing installation, the preparation of the as-built documentation, and the warranty inspections for a period of 5 years, in accordance with the requirements specified in Part IV SWZ. 3. The scope of the contract also includes conducting training for persons designated by the contracting authority, in accordance with the requirements specified in Part IV SWZ. 4. The detailed requirements related to the subject of the contract are an integral part of the contract subject description and are included in Part IV SWZ. 5. The contractor is obligated to provide the contracting authority with a quality guarantee and is obligated to perform the services resulting from it. The requirements regarding the guarantee have been specified in Parts III and IV SWZ. 6. The subject of delivery must be factory new, not exhibited at trade fairs, complete, and technically functional. The term “factory new” means the subject of the contract originally packaged, unused before the day of delivery, with the exception of use necessary to test its proper operation after production. 7. The subject of the contract must be free from any physical or legal defects as well as claims of third parties. 8. The delivered subject of the contract must come from the producer's distribution channel, not excluding distribution to the Polish market and ensuring the implementation of warranty rights. 9. The subject of the contract must be delivered with the device operating instructions and any accompanying software necessary for proper use of the subject of the contract (achieving full functionality as indicated in Part IV SWZ). If licenses, codes, or other permissions are needed to operate and use this software, they must be provided without additional charges. Codes, licenses, and other permissions must also be provided when necessary for the operation or configuration of hardware elements. Operating instructions, drivers, and any accompanying software must be delivered at the time of handover of the as-built documentation. 10. The subject of delivery, on the date of the offer, must not be scheduled by the manufacturer for withdrawal from production or sale. 11. The subject of delivery intended for power supply from the power grid must be connected to it in accordance with the designed electrical installation project, in accordance with Part IV SWZ. 12. The contractor and all persons performing the subject of the contract on their behalf or for their benefit are obligated to comply with the house rules in force on the contracting authority's premises. Non-compliance with the above will necessitate the suspension of work and the contractor and all persons performing the subject of the contract leaving the contracting authority's premises. 13. The scope of the contract also includes the preparation, after the completion of the installation of the delivered subject of the contract, of the as-built documentation. The documentation should be delivered in a paper version (2 copies) and in an electronic version on a data carrier or made available electronically and include, among others, catalog cards as well as installation and user instructions for the device. 14. The offered subject of the contract must comply with the RoHS directive – this applies to all elements specified in Part IV SWZ. 15. The contracting authority, due to the specificity of the subject of the contract, requires the contractor to conduct a local visit to familiarise themselves with the specifics of the location and the conditions for the implementation of the subject of the contract, which are useful for the preparation of the offer and the implementation of the subject of the contract. The local visit will be conducted at the contractor's expense. The manner and date of the local visit should be agreed with the contracting authority's representative, Mr. Rafał Mikołajczak, tel. +48 693 91 00 22, e-mail: [email protected]. The contracting authority informs that the local visit may take place during the contracting authority's working hours, i.e. from Monday to Friday, from 9:00 AM to 3:00 PM, excluding statutory holidays. The contracting authority requires the local visit to take place before the deadline for submitting offers. Proof of participation in the local visit will be an individual confirmation (a document prepared by the contracting authority) signed by the contracting authority's representative and the contractor directly after the completion of the local visit. This document will be attached to the tender documentation. The contractor who wishes to conduct a local visit is obligated to comply with the house rules in force on the contracting authority's premises. Explanations given orally during the local visit are of an informational nature only. All binding explanations of the content of SWZ require written form and communication with the contracting authority via the procurement platform. 16. The contractor's failure to participate in the local visit will result in the rejection of their offer under art. 226(1)(18) of the Pzp Act. 17. The contracting authority, pursuant to art. 441(1) of the Pzp Act, envisages the possibility of exercising the right of option to purchase the subject of the contract, specifically defined in point 2 of Part IV SWZ. The conditions for exercising the right of option have been specified in Parts I and III SWZ.
