Poland – Diesel oil – Sukcesywne dostawy oleju napędowego dla Miejskiego Przedsiębiorstwa Komunikacyjnego Spółka z o.o. w Nowym Sączu.

The subject of the contract is the successive delivery to the Contracting Authority of diesel fuel to its headquarters in a total quantity of up to 3,000 m³ over the entire contract period of 3 years, meeting at least the quality parameters in accordance with the standard PN – EN 590:+A1:2017-06E, suitable for the given time of year. The delivery of diesel fuel will be made based on each order by a tanker with a capacity of at least 30,000 litres. The Contracting Authority does not guarantee the Contractor that it will order diesel fuel in the amount of 3,000 m³, however, it reserves the right that the minimum ordered quantity will not be less than 70% of this amount, with the additional reservation that, due to reasons independent of the Contracting Authority, and having an impact on the non-utilisation of the minimum assumed quantity of diesel fuel, and in particular lockdown, war, crisis situations and other extraordinary circumstances, this quantity may be lower, and the Contractor will not be entitled to any additional claims in this regard. Based on Article 441(1) of the PZP Act, the Contracting Authority reserves the right to an option, consisting in reducing or increasing the quantity of oil deliveries depending on the needs of the Contracting Authority by a maximum of 30% (9,000 m³) in relation to the entire order, as well as the possibility of extending the contract implementation period by 6 months, which has been provided for in the tender documents.
