Germany – Telephone and data transmission services – Bereitstellung eines flächendeckenden Gigabitnetzes und Angebot breitbandiger Telekommunikationsdienste in unterversorgten Gebieten (Dunkelgraue Flecken) des Rhein-Kreises Neuss im Wirtschaftlichkeitslückenmodell.

The Rhein-Kreis Neuss (hereinafter: "Granting Authority") aims to establish comprehensive, high-performance access to gigabit networks. Furthermore, the Granting Authority aims to strengthen its business location and ensure the competitiveness of its companies. Therefore, concession contracts for the construction and operation of gigabit networks, as well as the provision of end-customer services, are to be concluded with telecommunications companies in the areas specified in more detail below. For this purpose, the Granting Authority has submitted a funding application within the framework of the federal funding programme "Promotion to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany - Gigabit Directive 2.0", 2nd amendment of 13.01.2025, and has been granted provisional funding. In addition, the Granting Authority has applied for co-financing in accordance with the "Directive of the State for the co-financing of the federal programme "Promotion to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany - Federal Gigabit Directive 2.0 (Gigabit-RL 2.0)"", Circular of the Ministry for Economic Affairs, Industry, Climate Protection and Energy of 19.09.2024, and an early start of measures has been permitted. The funding is to be provided through an investment grant in the amount of the so-called economic viability gap, i.e. in the amount of the difference between the net present value of all revenues and the net present value of the costs for network construction and operation. The conclusion of the grant agreement (see Annex 4 to the Service Description and Section D. V. 10 of the Accompanying Document to the Notice) is subject to the condition that the corresponding funds (also) be granted in final amount and the corresponding own contributions be made available by the participating cities and municipalities of the Rhein-Kreis Neuss in accordance with budgetary law.
