Poland – Aerial and related services – Usługi lotnicze w lasach w zakresie ochrony przeciwpożarowej i ochrony lasu w 2027 roku

1) The Contracting Authority acting on behalf and for the benefit of: Regional Directorate of State Forests in Białystok, Regional Directorate of State Forests in Gdańsk, Regional Directorate of State Forests in Katowice, Regional Directorate of State Forests in Lublin, Regional Directorate of State Forests in Łódź, Regional Directorate of State Forests in Olsztyn, Regional Directorate of State Forests in Piła, Regional Directorate of State Forests in Poznań, Regional Directorate of State Forests in Radom, Regional Directorate of State Forests in Szczecin, Regional Directorate of State Forests in Szczecinek, Regional Directorate of State Forests in Toruń, Regional Directorate of State Forests in Warsaw, Regional Directorate of State Forests in Wrocław, Regional Directorate of State Forests in Zielona Góra, is awarding a contract divided into 22 parts consisting of: a) fire prevention patrols in forests, b) firefighting in forests and their immediate vicinity, c) performing agrotechnical treatments in forests. 2) Contractors who do not fall under exclusion from the award procedure in the circumstances mentioned: a) in art. 108(1) of the Public Procurement Law (PZP), b) in art. 7(1) of the Act of 13 April 2022 on specific solutions to counter support for the aggression against Ukraine and serving to protect national security (i.e. Journal of Laws 2025 item 514), c) in art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.7.2014, p. 1 with later amendments), as amended by Council Regulation (EU) 2025/2033 of 23 October 2025. Since the value of the contract exceeds the equivalent in złoty of the amount for services of 10,000,000 euro, this procedure also involves an exclusion ground mentioned in art. 108(2) of the Public Procurement Law. 3) In order to confirm the absence of grounds for exclusion from the procedure, as mentioned above, the Contractor, upon the request of the Contracting Authority, within a period not shorter than 10 days indicated by it, will be obliged to submit to the Contracting Authority the following declarations and documents: a) information from the National Criminal Register regarding the grounds for exclusion indicated in art. 108(1)(1), (2) and (4) of the Public Procurement Law - issued no earlier than 6 months before its submission; b) information from the Central Register of Ultimate Beneficial Owners, regarding art. 108(2) of the Public Procurement Law, if separate provisions require entry into this register, prepared no earlier than 3 months before its submission; c) a declaration by the Contractor, regarding art. 108(1)(5) of the Public Procurement Law, of not belonging to the same capital group, within the meaning of the Act of 16 February 2007 on the protection of competition and consumers, with another Contractor who has submitted a separate offer or partial offer, or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the offer or partial offer independently of another Contractor belonging to the same capital group - (the template for the Contractor's declaration regarding art. 108(1)(5) of the Public Procurement Law on belonging or not belonging to this capital group is Annex No. 5 to SWZ); d) declarations by the Contractor on the currency of the information contained in the declaration referred to in art. 125(1) of the Public Procurement Law submitted on the form of the Single European Standardised Form (JEDZ), regarding the grounds for exclusion from the procedure specified in: a) art. 108(1)(3) of the Public Procurement Law, b) art. 108(1)(4) of the Public Procurement Law regarding the prohibition order to apply for public procurement as a preventive measure, c) art. 108(1)(5) of the Public Procurement Law regarding entering into agreements with other Contractors aimed at disrupting competition, d) art. 108(1)(6) of the Public Procurement Law and the currency of the information indicated in points 5.2 and 5.3 of SWZ (the template for the Contractor's declaration is Annex No. 6 to SWZ).
