Poland – Cleaning services – Wykonywanie kompleksowej usługi sprzątania w budynku i na terenie zewnętrznym Ministerstwa Funduszy i Polityki Regionalnej przy ul. Wspólnej 2/4 w Warszawie

1. The subject of the contract is the provision of comprehensive cleaning services, consisting of maintaining cleanliness and order in the building and on the external premises of the Ministry of Funds and Regional Policy (hereinafter MFiPR) at ul. Wspólnej 2/4 in Warsaw. 2. The Description of the Contract (OPZ) is contained in Annex No. 1 to SWZ - Description of the Contract (OPZ). A contract will be concluded with the Contractor whose offer is considered the most advantageous, on the terms specified in the PPU. The Purchaser envisages the possibility of making changes to the concluded contract, on the basis of art. 455 of the Act, in the manner and on the conditions described in detail in the PPU. 3. The Purchaser does not envisage the possibility of awarding the contract, as referred to in art. 214 para. 1 point 7 and 8 of the Act. 4. The Purchaser envisages the possibility of conducting a site visit by the Contractors. The intention to conduct a site visit should be notified no later than 3 working days before the deadline for submitting offers via the Procurement Platform at: https://zamowienia.mfipr.gov.pl/, and its date will be set by the Purchaser. During the site visit, the Purchaser does not provide explanations regarding the content of the SWZ. Persons who come to the site visit are obliged to report to the Purchaser's reception (entrance from ul. Wspólnej 2/4). 5. The Purchaser declares that the remuneration is co-financed from the funds of the European Union within the Technical Assistance Programme for European Funds 2021-2027. 6. The Purchaser does not require the provision of a bid bond. 7. The Purchaser reserves the right to first conduct an examination and evaluation of the offers, and then to qualify the Contractor. 8. The Contractor is obligated to provide, before signing the contract, security for the proper performance of the contract, in the amount of 3% of the total gross price offered for the execution of the contract. The security may be provided, at the Contractor's choice, in one or more of the following forms: 1) cash; 2) bank guarantees or cooperative savings and credit cash guarantees, with the proviso that the obligation of the cash is always a monetary obligation; 3) bank guarantees; 4) insurance guarantees; 5) guarantees issued by entities, as referred to in art. 6b para. 5 point 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development. More information about the security for the proper performance of the contract is provided in Chapter 16 of the SWZ. 9. A full description of the procedure, including a description and form of the documents submitted in the procedure, is provided in the Specification of Contract Conditions. 11. The contract will be executed over a period of 24 months, counting from the date of taking over the building. In the event of non-utilisation of the amount indicated in § 9 para. 1 of the contract, the Purchaser envisages the possibility of changing the contract conditions by extending the contract period, but not longer than by 3 months. 12. In accordance with the provisions of art. 95 para. 1 of the Act, the Purchaser requires that all persons assigned to perform the tasks of cleaning the rooms inside the building and cleaning the external area for the entire period of contract execution are employed under an employment contract, pursuant to the provisions of the Act of 26 June 1974 – Labour Code (Dz. U. z 2025 r., poz. 277 ze zm.). 13. Pursuant to art. 96 para. 2 lit. e) of the Act, the Purchaser requires that the Contractor ensures the participation during the execution of the contract of at least one person with a disability, employed under an employment contract, pursuant to the provisions of the Act of 26 June 1974 – Labour Code. A person with a disability is understood to be a person in respect of whom a decision on disability has been issued, pursuant to the Act of 27 August 1997 on vocational and social rehabilitation and employment of persons with disabilities (Dz. U. z 2026 r. poz. 884). 14. The procedure for awarding the public contract is conducted in the form of an open tender pursuant to art. 132 of the Act and the implementing acts issued on its basis. The procedure is part of a larger contract awarded in parts. 15. Communication between the Purchaser and the Contractors takes place in Polish via the Procurement Platform at https:/ zamowienia.mfipr.gov.pl/. The Purchaser does not envisage communicating with the Contractors in any other way than by using electronic communication means. The documentation of this procedure has been published on the Platform. Detailed information on the manner of communication between the Purchaser and the Contractors, as well as the manner of submitting declarations and documents, is provided in R. 2 SWZ. 1.
