Poland – Construction supervision services – Zarządzanie i sprawowanie nadzoru nad realizacją robót budowlanych w ramach zadania pn.: „Zabudowa systemu ERTMS/ETCS poziomu 2 na liniach kolejowych nr 133 i 134 odc. Sosnowiec Jęzor – Kraków Główny oraz linii kolejowej nr 91 odc. Kraków Główny – Podłęże” w ramach projektu pn.: „Zabudowa systemu ERTMS”

The purpose of this contract is to manage and supervise the implementation of the Investment Task entitled "Construction of the ERTMS/ETCS Level 2 system on railway lines No. 133 and 134 section Sosnowiec Jęzor – Kraków Główny and railway line No. 91 section Kraków Główny – Podłęże", in particular: a) Performing the role of the Engineer in accordance with the Agreement and Construction Contracts, including the Option Right in the scope in which the Contracting Authority will make use of it; b) Material-financial management, in particular comprehensive support of Construction Contracts in the scope of their settlement, monitoring and material-financial reporting; c) Technical management, including performing the duties of the Investor's Supervision Inspector for Construction Contracts in accordance with the Construction Law; d) Management, including coordination of all Construction Contracts concluded within the framework of the Investment Task with the Option Right in the scope in which the Contracting Authority will make use of it; e) Conducting environmental supervision (in the scope of controlling the impact of the construction process, among others, on surface and groundwater, noise, air, land surface, waste management, green management), in accordance with administrative decisions in the scope of environmental protection. Furthermore, controlling the construction stage in terms of the use of efficient machinery and equipment as well as their proper operation and maintenance, the use of transport and machinery without overloading and overloading, the removal of machinery after completed work and in case of failure to the designated parking place as well as nature conservation supervision (if nature conservation supervision is required), in accordance with administrative decisions in the scope of the environment (if required); f) Verification of the correctness of the documents submitted by the Contractor confirming the compliance of the structural subsystems with the basic requirements regarding interoperability at the design, construction and final subsystem test stages (where required); g) Ensuring that the Contractor signs an agreement with a notified body for the purpose of conducting a conformity assessment of the structural subsystems, which are the subject of the contract, with the basic requirements regarding interoperability, in accordance with the Contract. Checking the entitlements of the aforementioned body to conduct a conformity assessment of the indicated subsystems with the relevant provisions and notifying the Contracting Authority and the Contractor of any irregularities in this regard. Furthermore, ensuring that the Contractor is obliged to notify the President of UTK of the signing of the agreement with the notified body, in accordance with Article 25cb of the Act on Railway Transport (where required). 2. The scope of the Investment Task, over which the Contractor will provide the Management and Supervision Service, includes in particular: Construction contracts (No. 1-5) planned to be implemented in the "design and build" system, will be carried out in a multi-shift work system, and will include in particular the implementation of the following elements in the basic scope and appropriately in the scope of the Real Estate Option Right: a) design documentation, including: - geodetic documentation for design purposes, - preliminary documentation, - design concept (line equipment concept), - principles of preparing data for the ERTMS/ETCS system, operational scenarios for the ERTMS/ETCS system, - Test Cases for the ERTMS/ETCS system, - documentation constituting materials for the declaration of construction works, including construction projects: - development of the executive project, - development of technical solutions taking into account TSI procedures, - development of detailed technical specifications for the performance and acceptance of construction works, - development of documents necessary for the procedure of approving the ERTMS system by the European Union Railway Agency (so-called pre-authorization), - obtaining a usage permit, - post-construction geodetic inventory, - development of the commissioning report together with post-construction documentation, - carrying out certification together with obtaining permits for the operation of structural subsystems (if required), in accordance with the Act of 28 March 2003 on Railway Transport (i.e. Journal of Laws 2025 item 1234 with later amendments), - performing authorial supervision b) implementation of Works consisting of adapting the existing railway infrastructure in the fields: - train traffic control equipment (srk), - telecommunications equipment and systems, - power supply layout non-traction (including non-traction line needs), - electrical power up to 1 kV, - crossings and level crossings, - DSAT, - removal of collisions, two-level with external and internal networks. 3. The scope of the contract also includes the Term Option Right, described in Volume II SWZ - WU. 4. The Detailed Description of the Subject of the Contract is in Volume III SWZ - OPZ.
