Poland – Electricity, heating, solar and nuclear energy – Zakup energii elektrycznej do obiektów "Uzdrowisko Kołobrzeg" S.A. w Kołobrzegu przez 12 miesięcy

The subject of the contract is the sale by the Contractor of electrical energy for the needs of the Purchaser (Uzdrowisko Kołobrzeg S.A. in Kołobrzeg) to the Points of Energy Consumption (PPE) in the facilities indicated in point 2 below, in the parts having installed photovoltaic panels, along with the service of receiving and settling the electrical energy introduced into the Operator System Distributor (OSD) network from these micro-installations. The scope of the contract includes the sale of electrical energy to 16 Points of Energy Consumption (PPE) along with the receipt and settlement of electrical energy introduced into the OSD network from micro-installations for 6 PPE. The Contractor is obligated to possess a current concession, issued by the President of the Energy Regulatory Office, for conducting business activities in the field of electrical energy trading in accordance with the Act of 10 April 1997 – Energy Law, and a general distribution agreement in force at least until the end of the execution of the subject of the order, concluded with the Operator System Distributor, to whose network the Purchaser's facilities are connected, enabling the sale of electrical energy to the facilities covered by the order. The contract does not include electrical energy distribution services, carried out on the basis of a separate distribution agreement concluded by the Purchaser with the OSD, to whose network the PPE from Annex No. 6 are connected. A condition for the implementation of this Contract is the simultaneous validity of the distribution agreement. If the currently valid distribution agreement requires extension or changes necessary for the implementation of the sale of electrical energy by the Contractor in the performance of the order, the Contractor is obligated to make such an extension or changes to the distribution agreement on behalf of the Purchaser, and the Purchaser will grant the Contractor the necessary (prepared by the Contractor and approved by the Purchaser) powers of attorney. A change in the tariff based on the distribution agreement with the OSD cannot be the basis for changing the price of the sale of electrical energy by the Contractor.
