Description

The procedure for awarding the contract is conducted in the form of an unrestricted tender, as referred to in Article 132 of the Act on Public Procurement, hereinafter referred to as the "Act on Public Procurement".

5.1. Name of the task assigned by the Purchaser: Construction of the sanitary sewerage network in the localities of Przyłęki, Prądki and Ciele in the Municipality of Białe Błota – Stage I Part I

The subject of the contract is the construction of a gravity-pressure sanitary sewerage system in the localities of Przyłęki, Prądki and Ciele, Białe Błota Municipality, Bydgoszcz County, Kujawsko-Pomorskie Voivodeship, along with inspection wells, ventilation-ventilation inspection wells, pressure relief wells, and sewer connections. The Purchaser does not envisage the selection of the most advantageous offer with the possibility of conducting negotiations. The Purchaser makes the Specification of Contract Terms and all documents constituting its annexes available on the dedicated page of the procurement platform at the link http://platformazakupowa.pl/pn/bialeblota. The Purchaser allows changes to the contract only within the scope indicated in the contract project, which is an integral part of the SWZ.

5.3. The Specification of Contract Terms is hereinafter referred to as the "SWZ" or "Specification".

5.4. Description of the subject of the contract. The subject of the contract and the terms of the contract are described in detail in Volumes II and III of this SWZ. The required technical parameters are given in the design documentation and STWiOR.

5.5. The Purchaser does not allow the submission of partial offers. The scope and nature of the works covered by the contract require it to be included within one task due to the special nature of the works. The tasks require efficient coordination of works between brigades, the division of equipment and materials. Dividing the works into parts would be associated with excessive technical difficulties, extended implementation time and increased costs of task execution. The organisation of works must take place within one company to ensure efficient implementation of the task.

5.6. The Purchaser does not allow the submission of variant offers.

5.7. The execution of the contract is subject to Polish law, in particular the Civil Code and the Act on Public Procurement. The Contractor will be obliged to carry out the construction works in accordance with Polish law, in particular with technical and construction regulations, regulations concerning independent technical functions in construction, and regulations concerning products and materials used in construction.

5.8. The Purchaser does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(7) of the Act on Public Procurement.

5.9. The Purchaser does not require Contractors to conduct a site visit, as referred to in Article 131(2) of the Act on Public Procurement. The Purchaser recommends conducting a site visit of the places where the construction works covered by this contract will be carried out in order to check the conditions of the construction site and the conditions related to the performance of the works that are the subject of this procedure, and in order to obtain any additional information necessary and useful for the valuation of the offer.

5.10. The requirements for the employment by the Contractor or subcontractor, on the basis of an employment relationship, of persons performing the activities indicated by the Purchaser in the context of the implementation of the contract have been specified in the further part of the SWZ. The above requirements specify in particular: a) the type of activities related to the implementation of the contract, which are subject to the requirements of employment on the basis of an employment relationship by the Contractor or Subcontractor of persons performing activities during the implementation of the contract, b) the method of verifying the employment of these persons, c) the Purchaser's rights in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons and the sanctions for non-compliance with these requirements. The Purchaser requires the employment, on the basis of an employment contract, by the contractor or subcontractor of persons performing all physical works related to the performance of all activities covered by the contract and described in the OPZ, the performance of which consists in performing work in the manner specified in Article 22(1) of the Act of 26 June 1974 - Labour Code: sewer network installation worker/monter, brigade leader, assistant, excavator operator, excavator-loader operator, compactor operator, lorry driver, persons who perform activities directly related to the performance of works, i.e. so-called physical workers. The obligation, referred to in the previous sentence, does not apply to persons performing independent technical functions in construction within the meaning of the Act of 7 July 1994 - Construction Law. The method of verifying the employment of persons performing work in the manner specified in Article 22(1) of the Act of 26 June 1974 - Labour Code and the Purchaser's rights in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons and the sanctions for non-compliance with these requirements have been specified in the contract project, which is an integral part of the SWZ.

5.11. The Purchaser does not specify the requirements, as referred to in Article 96(2) of the Act on Public Procurement.

5.12. The Purchaser does not reserve the possibility of applying for the award of the contract exclusively to contractors, as referred to in Article 94 of the Act on Public Procurement.

5.13. The Purchaser requires, in accordance with the description of the subject of the contract, that the subject of the contract be implemented taking into account the requirements in the scope of accessibility for disabled persons.

5.14. The Purchaser does not require the submission of electronic catalogues with the offer.

5.15. The Purchaser does not envisage an electronic auction.

5.16. The Purchaser does not envisage settlement in foreign currencies.

5.17. SUB-CONTRACTING AND KEY PARTS OF THE CONTRACT:

a) The Purchaser does not reserve the obligation for the Contractor to personally perform the key parts of the contract.

b) The Contractor may entrust the performance of part of the contract to a subcontractor.

c) The Purchaser requires the Contractor to indicate the parts of the contract, the performance of which it intends to entrust to subcontractors, and to provide the names of the subcontractors, if known, in accordance with point 10.7 of the IDW.
