The subject of the contract is the purchase of the service of supporting the production of proprietary software - Body Leasing. The detailed description of the subject of the contract (OPZ) is contained in the Draft contract provisions constituting Annex No. 2 to the SWZ. 1. Pursuant to Article 16b(2) of the Act, the Contracting Authority informs that it does not accept tenders containing services originating from third countries, i.e. from countries that are not Member States of the European Union or countries with which the European Union has concluded agreements guaranteeing, on the basis of reciprocity and equality, access to the market for public procurement, as referred to in Article 16a of the Act. A tender containing such a service will be rejected under Article 226(1)(5) of the Act as non-compliant with the SWZ. 2. In order to assess whether a tender is to be rejected, as referred to in point 1, the Contracting Authority will examine the origin of the service on the basis of the origin of the Contractor/Entity providing it. 3. The Contracting Authority explains that in this procedure, by a service originating from third countries, it means: 3.1. the provision of comprehensive services relating to: the production, modernisation of the Institute's domain applications, improvement of the quality of the source code, expert support in the field of system analysis of applications being designed, produced or changed, expert support in the field of testing applications being produced or changed, expert support in the field of production or editing of project documentation of applications, organisation of work in the role of Scrum Master on the side of the Contractor, involving the production, modernisation of domain applications together with the necessary documentation and analysis of documentation, participation in meetings relating to applications being produced or changed and documentation. 4. The subject of the contract are ICT services within the meaning of the Act of 5 July 2018 on the national cybersecurity system (i.e. Journal of Laws of 2026, item 20 as amended).
