Poland – Repair and maintenance services of security equipment – Usługi serwisowe Systemów Ochrony Technicznej i Systemów Sygnalizacji Pożarowej na obiektach PSE S.A.

The subject of the contract are the maintenance services for Technical Protection Systems (TPS) and Fire Alarm Systems (FAS) at PSE S.A. facilities 2) The detailed description of the subject of the contract is in Section II SWZ – Description of the subject of the contract and Section IV SWZ – Draft contract terms. 3) The subject of the contract has been divided into 5 parts, hereinafter referred to as Packages. Details regarding the Packages are in Section II SWZ. 4) Pursuant to Article 101(4) of the Act, the Contracting Authority allows equivalent solutions described in the SWZ using standards, technical assessments, technical specifications and technical reference systems, as referred to in Article 101(1) point 2 and Article 101(3) of the Act, if they allow obtaining features or parameters not worse than those mentioned. Pursuant to Article 101(5) of the Act, the Contractor who refers to equivalent solutions described by the Contracting Authority is obliged to prove in the offer that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 5) The Contracting Authority requires the Contractor to indicate in the offer the parts of the contract, the execution of which the Contractor intends to entrust to Subcontractors and to provide the names of the Subcontractors, if they are already known. 6) Name and code of the Common Procurement Vocabulary: CPV Code: 50610000-4 - Maintenance and repair services for safety equipment. 7) The Contracting Authority does not require the submission of subject evidence with the offer. 8) Acting pursuant to Article 133(3) of the Act, the Contracting Authority establishes requirements regarding the confidentiality of information provided to Contractors during the procedure. The following parts of the SWZ are confidential: a. Annex No. 1-5 to Section II SWZ – Description of the subject of the contract, i.e. List of devices. 9) A Contractor who wishes to obtain a password to decrypt the above documents must submit a declaration, the content of which is indicated in templates No. 12.1 and No. 12.2 of Section III SWZ. It is required to submit a declaration by persons authorized to represent the Contractor (this authorization must result from registration documents or a power of attorney, which the Contracting Authority has in this procedure) and by persons who will participate in the procedure. The Contracting Authority allows, if the persons submitting these declarations do not have qualified electronic signatures, for these declarations to be signed manually by the persons submitting the declarations, scanned, confirmed for conformity with the original by persons authorized to submit declarations of will and knowledge on behalf of the Contractor and in such a form sent to the Contracting Authority via the Procurement Platform. The Contracting Authority informs that letters with answers to questions (if any are submitted during the procedure) will also be published in an encrypted form – to decrypt it will be necessary to use the above password (this password will be used throughout the procedure). The declaration should be sent via the Procurement Platform, tab ,,Questions/information”. After their receipt and verification, the password to decrypt the documents will be sent to the e-mail address indicated in the information about the submission of the password to decrypt the documents. 10) In order to gain access to the confidential part of the OPZ, the Contractor submits, via the Procurement Platform, an application for access to the confidential part of the OPZ together with a properly completed declaration of confidentiality. The confidential part of the OPZ will be sent to the Contractor via the Procurement Platform after submitting a proper declaration of confidentiality. The Contractor is obliged to maintain the confidentiality of the information provided and to use it exclusively for the purpose of preparing an offer in this procedure. The Contracting Authority recommends submitting an application for access to the confidential part of the OPZ together with a declaration of confidentiality within a timeframe that allows the Contracting Authority to verify the declaration and provide access to the confidential part of the OPZ, and the Contractor to familiarize themselves with its content and properly prepare the offer. Submitting an application within a timeframe that does not allow for real familiarity with the confidential part of the OPZ before the deadline for submitting offers does not constitute a basis for requesting an extension of the deadline for submitting offers. The Contracting Authority requires that the subject of the contract, including all ICT products, ICT services and ICT processes, in the sense of Article 2 points 11k, 11l and 11m of the Act of 5 July 2018 on the national cybersecurity system, used for the implementation of the contract – both as main elements and components, elements of the contract implementation environment or accompanying solutions – do not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation of the Plenipotentiary of the Government for Cybersecurity, referred to in Article 33(4) and (4a) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of the security of the state; 2) ICT products, ICT services or ICT processes, the type of which was determined in the decision of the minister competent for informatization regarding the recognition of the supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system. Failure to meet the above requirement will result in the rejection of the offer, in the case of public contracts pursuant to Article 226(1) point 17 or point 19 of the Act of 11 September 2019 – Public Procurement Law. The Contracting Authority reserves the right to verify compliance with the above requirement at any stage of the procedure.
