With reference to the provisions of paragraph (3) of section 46 of the R., the AK draws attention to the fact that if the unambiguous and generally understandable definition of the subject of the procurement made it necessary to refer to a specific branded, sourced, typed item, procedure, activity, person, patent or trademark, the mention was made only in the interest of unambiguously defining the nature of the subject, and in every case "or an equivalent" is to be understood next to the mention.

The AK draws attention to the fact that in the case of the offer of an equivalent item, the equivalence must be proven by the bidder in the bid.
