The subject of the order are: successive deliveries of milk and dairy products in 2027 for 41. Bazy Lotnictwa Szkolnego in Dęblin. Deliveries must be made in accordance with the standards, assortment, quantities and all the requirements specified in Section IV of the SWZ, as well as the quality requirements specified in the "Minimum Quality Requirements" constituting the "Detailed Description of the Subject of the Order" for individual assortment positions – Annex No. 2 to the SWZ. The conditions and rules for the implementation of this order are also specified in the "draft provisions of the contract for the public order, which will be introduced into the contract for the public order" constituting Annex No. 5 to the SWZ. Each delivery of the subject of the order must meet the quality requirements specified in Annex No. 2 to the SWZ – "Minimum Quality Requirements" containing detailed descriptions of the subject of the order for individual assortment positions. The ordering party does not divide the order into parts, and consequently does not allow partial offers to be submitted. The contractor may submit an offer for the full subject range of the order. Deliveries of goods will be made successively on the basis of orders placed during the validity of the contract, within 12 months from the date of signing the contract, (but not earlier than from 01.01.2027) or until the earlier exhaustion of the total gross value of the contract, of which § 2 para. 1 of the contract resulting from the estimated quantities of the subject of the order specified in individual assortment positions (Annex No. 5 to the SWZ), covering remuneration within the framework of the basic order and the right of option (depending on which event occurs first). In the event of the implementation of the contract being postponed to 2028, the condition will be to ensure (allocate) financial resources for its implementation, and in the event of a restriction of these resources – within the scope and up to the amount of resources specified in the amended financial plan. The contractor undertakes to deliver the goods successively - twice a week: Monday and Thursday, from 8.00 to 10.00, on the basis of orders placed by the ordering party, containing precisely specified quantities of goods and delivery dates. Orders will be sent at least two days before the planned delivery of goods to the warehouse. Due to the specifics of the organisation of catering in 41. Bazy Lotnictwa Szkolnego in Dęblin (i.e. ensuring the catering of flying personnel, courses, training, ceremonies, variable number of persons entitled to catering, etc.) it is possible to change the established method of implementing deliveries. Details regarding changes in delivery frequency (how many times a week and on which days) will be agreed by the parties after signing the contract in working contacts. Orders will be placed with the Contractor by e-mail/fax and by telephone. The ordering party will notify the contractor of the exact delivery date at least 24 hours in advance. The contractor allows the possibility of the ordering party correcting a previously submitted order with at least 12 hours' notice before the planned delivery date. In particularly justified cases, which despite exercising particular diligence were impossible to predict earlier (e.g. achieving higher states of combat readiness, field training, reserve personnel training, courses, training, preparatory services, change in the number of persons entitled to catering, restructuring of the armed forces, liquidation of natural disasters, crisis, threat or war, change in legal acts in the scope of entitlements to catering of entitled persons or other obligations imposed by state authorities and other situations independent of the ordering party), the contractor will guarantee the implementation of deliveries at different times and frequencies and to places (within the territory of the Republic of Poland) than specified in the contract, at the prices specified in the contract. The ordering party does not reserve the obligation for the contractor to personally perform key tasks related to work associated with placement and installation, within the framework of the order for deliveries. The contractor, in accordance with art. 462 para. 1 of the Pzp Act, may entrust the performance of part of the order to a Subcontractor. In such a case, the ordering party, in accordance with art. 462 para. 2 of the Pzp Act, requires the contractor to indicate in the offer - in the offer form (Annex No. 1 to the SWZ) part of the order, the performance of which it intends to entrust to subcontractors and to provide the names of potential subcontractors, if they are already known. Settlements exclusively in Polish zlotys. The ordering party does not envisage granting orders, as referred to in art. 214 para. 1 item 8 of the Pzp Act. Permissible changes to the contract in Annex No. 5 to the SWZ. Requirements regarding defects – Section XI of the SWZ. Form of submitted documents – Section VIII of the SWZ. Information on electronic communication channels – Section IX of the SWZ. The ordering party envisages the possibility of invalidating the procedure on the basis of art. 257 of the Pzp Act in a situation where the public funds, which it intended to allocate for the financing of the whole or part of the order, are not granted to it. The ordering party does not allow: variant offers, electronic catalogues; does not envisage: electronic auction; dynamic purchasing system; allows subcontracting. Reverse procedure: The ordering party informs that in accordance with art. 139 para. 1 of the Pzp Act, it will first carry out an examination and evaluation of offers, and then carry out a subject qualification of the contractor, whose offer was most highly evaluated, in the scope of the absence of grounds for exclusion and the fulfilment of the conditions of participation in the procedure. The procedure is conducted in the form of an unrestricted tender with an estimated value exceeding the equivalent of 140,000.00 euros in zlotys.
