Poland – Animal products, meat and meat products – SUKCESYWNA DOSTAWA MIĘSA CZERWONEGO, WĘDLIN Z MIĘSA CZERWONEGO, TŁUSZCZY ZWIERZĘCYCH, DROBIU I WĘDLIN DROBIOWYCH NA ROK 2027

The order has been divided into 4 (four) parts, each of which constitutes a separate order. The contractor may submit a tender for any part or parts or for the entire subject of the order. The contractor may submit only one tender in Polish for all or any given part/parts. All provisions and requirements contained in the SWZ apply to each part of the order unless a specific provision states otherwise. 2. The quantitative breakdown of the subject of the order is presented in Annex No. 1 to the SWZ. The detailed description of the subject of the order for parts I, II, III and IV of the order is contained in Annex No. 13 – 16 to the SWZ, attached separately. 3. The contractor is obliged to have, for the entire period of validity of the Contract, an up-to-date insurance policy or other document confirming the conclusion of an insurance contract for civil liability (tort) arising from the conduct of activities related to the subject of the Contract, covering liability for personal and property damage caused by the products supplied by the contractor, in an amount not lower than the maximum total value of the contractor's remuneration specified in the Contract, covering remuneration for the basic scope and the maximum value of the order covered by the right of option (§ 9(1)(3) of the Contract). The policy must be concluded for a period covering at least the period of implementation of the contract. In the event of the expiry of the validity period of the documents confirming insurance in the above scope, the contractor is obliged to extend their validity and to provide the Contracting Authority with a photocopy of the document (confirmed by the contractor to be consistent with the original) confirming the continuity of the above document. 4. The Contracting Authority is entitled to change the assortments provided for in the contract to other assortments provided for therein, with the proviso that the value of the entire contract may not change. The change may relate to the type of assortment, as well as their quantity. The Contracting Authority shall notify the contractor by e-mail of the changes and specify the period of validity of the changes. 5. The contractor may entrust the implementation of elements (parts) of the subject of the order to subcontractors. In the event of intending to carry out the subject of the order with the participation of subcontractors, the contractor is obliged to indicate in his tender: the part of the order (material scopes), the implementation of which he intends to entrust to subcontractors and to provide the names of the subcontractor firms. The subcontractor should have the appropriate permits in accordance with the applicable law. Like the contractor, it should not be excluded from the procedure. 3) If the assignment of the implementation of a part of the order for delivery to a subcontractor takes place during its implementation, the contractor, at the request of the Contracting Authority, presents a declaration of compliance with the conditions of participation and non-exclusion from the procedure as well as declarations and documents confirming the absence of grounds for exclusion in respect of that subcontractor and further subcontractors. The Contracting Authority may exclude the subcontractor from the procedure. The contractor shall immediately inform the Contracting Authority of any changes regarding subcontractors that occur during the execution of the order. If the technical or professional capacity or the economic or financial situation of the subcontractor does not confirm compliance with the conditions of participation or there are grounds for exclusion in respect of these entities, the Contracting Authority requires the contractor to replace this entity with another or to undertake to personally perform the relevant part of the order, if it demonstrates technical or professional capacity or economic or financial situation. In accordance with art. 462(7) of the Act, if the change or resignation of the subcontractor concerns an entity on whose resources the contractor relied, on the basis of art. 118(1) of the Act, in order to prove compliance with the conditions of participation in the procedure, the contractor is obliged to prove to the Contracting Authority that the proposed other subcontractor or the contractor himself independently meets them to a degree not less than the subcontractor on whose resources the contractor relied during the procedure for the award of the order, art. 122 of the Act shall apply accordingly. 6.
