Poland – Miscellaneous food products – Sukcesywna dostawa artykułów ogólnospożywczych dla wskazanych jednostek podległych Gminie Stalowa Wola.

The subject of the order is the successive delivery of foodstuffs for the indicated units subordinate to the Municipality of Stalowa Wola, specified according to the assortment-price groups for the individual units served, constituting Annex No. 2 (assortment-price form) to the specification of the order conditions:

3. The subject of the order will be implemented successively in the quantities resulting from the demand submitted directly by the Served Unit. Deliveries will be made based on an order placed by telephone, e-mail, or fax, by an employee authorized by the unit.

4. The quantities specified in the assortment-price form are estimated and may decrease/increase during the implementation of the contract, and the Contractor is not entitled to any compensation for this reason.

5. It is possible to change the quantity of individual assortments listed in the Assortment-Price Form – Annex No. 2 to SWZ. All those indicated in SWZ Orderers (served unit) have the right to order all the products listed in the Assortment-Price Form – Annex No. 2 (even in the case of indicating the quantity position "0") at unit prices.

6. The Orderer undertakes to order goods that are the subject of the procedure with a minimum order value of 20% gross as specified in the offer.

7. The financial settlement of the Contractor with the Orderer will take place based on the quantity and type of food products actually delivered to the Served Unit and their unit prices given by the Contractor in the assortment-price form, i.e. FV payable by transfer, with a payment term of 30 days, on a weekly basis. It is allowed to invoice each delivery of goods or monthly for successive deliveries made within 1 calendar month, at the request of the authorized person/intendant in the given unit.

8. The Contractor will deliver the ordered batch of goods to the indicated units on working days during the hours specified by the given Ordering Unit, by their own means of transport and at their own risk, and will not charge the units with transport costs. The Contractor is obliged to deliver the goods to the food warehouses indicated by the Orderers, located in the facilities of the given units, regardless of whether the storage space is on the ground floor or on the floor, e.g., in a kindergarten canteen.

9. The means of transport must meet the sanitary requirements in force for the transport of foodstuffs.

10. The Contractor will lend containers, boxes, etc., free of charge for each delivery of goods to the Orderer's premises until the next delivery.

11. All products covered by the order must be delivered in appropriate packaging and boxes (packaging material allowed to come into contact with food).

12. Authorized employees of the individual units (intendant and kitchen manager) will carry out the acceptance of goods in terms of quantity-value and applicable quality standards. The units have the right to refuse to accept goods in case of quantity or quality defects.

13. In case of questioning by the given Served Unit of the delivered goods, the Contractor undertakes to replace them with a full-value item within a period not longer than 2 working days from the complaint. The complaint time constitutes an off-price criterion for evaluating offers (Kt). In case of failure to deliver full-value goods after a complaint, the Served Unit is entitled to purchase the goods at the Contractor's expense.

14. The questioned goods will be returned to the Contractor and collected by transport at the Contractor's expense. The Served Unit is not liable for losses incurred by the Contractor due to the return of the questioned batch of goods.

15. Goods showing any signs of spoilage (smell, colour, consistency, insects in products), poor expiry date, poor validity period, and mechanical damage to the inner and outer packaging (torn packaging, cracked or crushed boxes) should be replaced from the moment of notification by the Orderer in accordance with the complaint time declared by the Contractor, constituting an off-price criterion for evaluating offers.

16. Food products should be delivered in original, undamaged packaging containing factory markings, i.e., type, name of the product, quantity, expiry date, name and address of the manufacturer, and other markings in accordance with the applicable food law provisions. Delivered food products, depending on their category, must have all the necessary documents required by food law provisions with each delivery.

17. The expiry date or validity period on the individual packaging of the given assortment, counted from the moment of its delivery, will not be shorter than ½ of the expiry/validity period specified by the manufacturer.

18. The delivered products must comply with the Regulation of the Minister of Health of 16 February 2026 on groups of foodstuffs intended for sale to children and young people in educational system units and the requirements that foodstuffs used in the collective nutrition of children and young people in these units must meet (Journal of Laws of 20 February 2026, item 197). The Orderer additionally reserves that no food products may contain the following substances or food additives, which should not be found in a child's diet: guar gum, sulphur dioxide, saccharin, aspartame E951, phosphoric acid E338, food colourings (E100-E199), artificial flavours, sodium benzoate E211.

19. In their composition, the ordered products under no circumstances may contain preservatives, enhancers, artificial colourings, etc. (unless otherwise stated in the product description contained in Annex No. 2 to SWZ). The ordered products should be delivered in packaging allowed to come into contact with food.
