Poland – Repair and maintenance services of rolling stock – Naprawa P4 EZT serii EN57-1920

The subject of the contract is the execution of maintenance level P4 repairs to the electric traction unit (ETU) series EN57-1920. 2. As part of the subject of the contract, the Contractor will carry out the modernization of the toilet and monitoring system as well as additional works. 3. In all records of the SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the Pzp Act, the Purchaser allows the application of solutions equivalent to the solutions described in the standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes, if they allow to obtain features or parameters no worse than those referred to in the SWZ and annexes. In the case of applying equivalent solutions, the Contractor is obligated to prove in writing the equivalence of the offered technical parameters in relation to the subject of the contract. The Contractor will prove in the offer, in particular by means of the subject evidence, referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 4. The Purchaser requires the submission of the subject evidence referred to in paragraph 3 (if applicable). If the Contractor does not submit the subject evidence or the submitted subject evidence is incomplete, the Purchaser, in accordance with the provisions of Article 107(2) of the Pzp Act, will call for the submission or supplementation of the subject evidence referred to in paragraph 3 (if applicable). 5. If the Contractor intends to invoke an official certificate, referred to in the Act of 5 August 2025 on the certification of public procurement contractors, they are obligated to indicate this in Section II, Section A of the JEDZ, providing: the certificate number and designation, the full name of the certifying body that issued the document, the validity period of the certificate and the exact scope of the exclusion criteria or conditions of participation in relation to which the Contractor invokes this certificate. 6. The detailed description, scope, requirements and method of implementation of the contract have been defined in the Draft Contract Terms constituting Annex 1 to the SWZ.
