The subject of this public procurement is the development of an idea project for the reconstruction and revitalisation of the pedestrian underpass "Trimontsium" and the adjacent urban area, with a territorial scope: underground space + above-ground approaches and adjacent public spaces. The scope of the development includes the pedestrian underpass "Trimontsium" representing PI 56784.521.1382 and PI 56784.523.4022, located in Plovdiv, "Central" district, "Tsar Boris III Unifier" Blvd. The competition is held with the aim of acquiring an idea project – a basis for the subsequent assignment of design in the technical phase. The total estimated value of the project competition is 255 500 euros excluding VAT and is determined in accordance with Article 80, paragraph 3 of the Public Procurement Act as a sum of the awards and the estimated value of the public procurement of the service, which may be assigned through a negotiated procedure without prior notice. The final technical, financial and contractual conditions, including the execution price, will be the subject of negotiations in the subsequent procedure. The provision for subsequent negotiation does not create an unconditional obligation for the contracting authority to conclude a contract. A contract is concluded upon agreement on the terms of execution and upon secured financing. By participating in this competition, the participants who have received awards explicitly agree that in the event of a refusal by the participants ranked first and second to participate in the procedure in accordance with Article 79, paragraph 1, item 9 of the Public Procurement Act, or in the event that the negotiated procedure without prior notice does not conclude with the conclusion of a public procurement contract, the Contracting Authority has the right to conduct a procedure for the selection of an executor for the development of an investment project in the "technical" and "working" project phases, using their conceptual projects. The awarded projects are works created to order within the meaning of Article 42 of the Copyright and Related Rights Act. After the payment of the awards to the accounts of the participants, as indicated in the applications, the contracting authority acquires the right to use the projects of the ranked participants without the participants' consent and without owing additional remuneration for this. The total amount of the prize fund is 30 000 euros excluding VAT, distributed as follows: I Prize: 15 000 € (fifteen thousand euros) and the anticipated possibility of subsequent assignment of the development of technical and working investment project through a negotiated procedure without prior notice in accordance with Article 79, paragraph 1, item 13 of the Public Procurement Act, under the conditions of the current Bulgarian legislation and in the presence of secured financing. II Prize: 8 000 € (eight thousand euros). III Prize: 5 000 € (five thousand euros). Two encouragement awards of 1 000 € (one thousand euros) at the discretion of the jury.
