Description

The subject of the contract is the acceptance and management of municipal waste from waste collection entities on behalf of the Wierzyca Commune Association, which originates from the owners of residential properties and owners of properties with holiday homes and other properties used for recreational purposes, collected from properties located in the territories of the communes participating in the Wierzyca Commune Association as specified in the Contract Template and under the conditions described in the detailed description of the subject of the contract, which is attachment no. 1 to the Contract Template.

The Contractor will manage municipal waste from the following communes: Bobowo, Kościerzyna rural commune, Kościerzyna urban commune, Lubichowo, Nowa Karczma, Przywidz, Skórcz rural commune, Skórcz urban commune, Smętowo Graniczne, Stara Kiszewa. As part of the contract, the Contractor will manage the following waste fractions:

15 01 06-Mixed packaging waste

15 01 07-Glass packaging

15 01 10*-Packaging containing residues of hazardous substances or contaminated with them

16 01 03-Used tyres

17 01 03-Other ceramic materials and equipment elements

17 01 07-Mixed waste from concrete, brick rubble, other ceramic materials and equipment elements not listed in 17 01 06

17 02 01-Wood

17 02 02-Glass

17 02 03-Plastics

The Contractor will accept waste from the entities indicated by the Contracting Authority and then manage it in accordance with the waste management hierarchy, as mentioned in Article 17 of the Act of 14.12.2012 on waste.

Maximum amount of municipal waste to be managed during the contract period: 20,082.41 Mg

Minimum amount of municipal waste to be managed during the entire contract period: 19,354.78 Mg.

In the event that the set maximum amount of municipal waste to be managed during the entire contract period is not achieved, the Contractor will not be entitled to any claims. Payment will be settled based on the actual amount of waste managed.

The detailed description of the subject of the contract is contained in attachment no. 1 to the contract – Description of the subject of the contract. The detailed description of the conditions for the implementation of the subject of the contract is contained in the Contract Template, which is attachment no. 2 to the SWZ.

II. In accordance with Article 95(2)(1) of the Pzp, the Contracting Authority requires that activities related to the operation of sorting lines of installations be carried out by persons employed by the Contractor or Subcontractor under an employment contract. The Contractor is obliged to submit to the Contracting Authority a declaration from the Contractor or Subcontractor regarding employment under an employment contract of persons performing the above-mentioned activities. The declaration should contain information, including personal data, necessary to verify employment under an employment contract, in particular the name and surname of the employed worker, the date of conclusion of the employment contract, the type of employment contract and the scope of the worker's obligations. The first declaration the Contractor will submit without waiting for a request from the Contracting Authority within 7 calendar days, counting from the date of commencement of the waste management service. Each subsequent declaration the Contractor will submit within 7 calendar days from the date of receiving the appropriate request from the Contracting Authority. The Contracting Authority has the right at each stage of the contract implementation to request confirmation by the Contractor of the fact of employment of persons under an employment contract by submitting a declaration, as mentioned above. Failure by the Contractor to submit a declaration within the required time will be treated by the Contracting Authority as evasion from the obligation to employ persons under an employment contract and will result in the imposition of penalties provided for in §5(5) of the contract. The Contracting Authority may request an inspection by the State Labour Inspectorate in a situation where there are doubts about the manner of employment of persons operating the sorting lines of the installations.

III. Contractors are excluded from the procurement procedure, with the reservation of Article 110(2) of the Pzp, in relation to whom any of the circumstances mentioned in Article 108(1) of the Pzp apply. Contractors are excluded in relation to whom the circumstances indicated in Article 5 of Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine or Article 7(1) of the Act of 13.04.2022 on special solutions in the field of counteracting the support for the aggression on Ukraine and serving the protection of national security.
