The subject of the contract is the removal of excess biomass (logs, piles of branches, etc.) from the dome of the Baligówka peatbog, which resulted from tree felling. 2. The purpose of the contract is to improve the proper condition of the high peatbog, through the least invasive collection and transport of excess biomass (logs, piles of branches, etc.) outside the dome of the peatbog and its further management/ utilization. In Annex No. 1- OPZ, in point III, the minimum parameters are described, upon reaching which, an improvement in the condition of the peatbog is envisaged. 4. A detailed description of the subject of the contract is specified in Annex No. 9 OPZ 5. The Contracting Authority, pursuant to art. 95 para. 1 of the Act, requires that the Contractor or subcontractor employ, on the basis of an employment relationship, persons directed by the Contractor or subcontractor to perform tasks involving physical work, such as: collecting and transporting excess biomass (logs, piles of branches, etc.), if the performance of these tasks involves performing work in the manner specified in art. 22 § 1 of the Labour Code of 26 June 1974. The Contractor is obliged to ensure that the employees are employed on the basis of an employment relationship for the duration of the contract, at least for the period of performing the above-mentioned tasks. 6. The Contracting Authority informs that the initiation of this procedure was preceded (in the period from 08-12.08.2025) by preliminary market consultations, conducted pursuant to art. 84 of the Act. The tender is submitted in the procedure, under pain of invalidity, in electronic form, i.e. with a qualified electronic signature. III. 1. Documents submitted by the contractor together with the tender: 1) completed Tender Form (Annex No. 1 to SWZ), together with the attached cost estimate; 2) the "Work Organisation Concept" attached to the tender, submitted by the Contractor in order to confirm and ensure higher quality of contract performance. 3) power of attorney or other document confirming the authority to represent the contractor – if the tender or statements or documents attached thereto are signed by a proxy. 4) power of attorney to represent all Contractors jointly applying for the award of the contract, or a cooperation agreement, from which the subject power of attorney will result. 5) JEDZ (in accordance with the instruction from Annex No. 2 to SWZ), appropriate as of the date of submission of tenders, for the purpose of temporary confirmation that the Contractor does not fall under exclusion from the procedure on the basis of art. 108 para. 1 and art. 109 para. 1 points 4, 5, 7, 8 of the Pzp Act and meets the conditions for participation in the procedure specified in SWZ. In the case of joint application for the contract by Contractors, JEDZ is submitted by each of the Contractors jointly applying for the contract; 6) JEDZ regarding other entities, on whose resources the Contractor relies, for the purpose of temporary confirmation, as of the date of submission of tenders, of the absence of grounds for exclusion on the basis of art. 108 para. 1 and art. 109 para. 1 points 4, 5, 7, 8 of the Pzp Act and compliance with the conditions for participation in the procedure specified in SWZ, to the extent to which the Contractor relies on their resources; 7) in the case where the Contractor relies on the capabilities or situation of entities providing resources: evidence confirming that the Contractor, while performing the contract, will have the necessary resources of other entities, which constitutes in particular the obligation of these entities to make the necessary resources available to the Contractor for the purposes of performing the contract or other documentary evidence confirming that the Contractor, while performing the contract, will have the necessary resources of these entities. 8) a declaration by the Contractor for the purpose of temporary confirmation, as of the date of submission of tenders, that it does not fall under exclusion on the basis of art. 5k of Regulation (EU) 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, added in art. 1 point 23) of Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine together with Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (hereinafter: Regulation 2025/2033) and art. 7 para. 1 of the Act on special solutions in the field of counteracting the support of aggression on Ukraine and serving the protection of national security. 9) a declaration of another entity, on whose resources the Contractor relies, submitted for the purpose of temporary confirmation, as of the date of submission of tenders, that this entity does not fall under exclusion from the procedure on the basis of art. 5k of Regulation (EU) 2025/2033) and art. 7 para. 1 of the Act on special solutions in the field of counteracting the support of aggression on Ukraine and serving the protection of national security, in accordance with the template constituting Annex No. 8 to SWZ; 10) a declaration of Contractors jointly applying for the award of the contract, from which it follows which services will be performed by the individual contractors, in accordance with the template constituting Annex No. 7 to SWZ (if applicable); III. The Contractor is excluded from the procedure for the award of the contract, with the reservation of art. 110 para. 2 of the Pzp Act, on the basis of: art. 108 para. 1 of the Pzp Act, art. 109 para. 1 points 4, 5, 7, 8 of the Pzp Act and on the basis of: 1. art. 5k of Regulation (EU) 2025/2033 and art. 7 para. 1 of the Act of 13 April 2022 on special solutions in the
