The subject of the contract is the preparation and conduct of training for road managers in the field of traffic organization on municipal roads in the territory of 16 voivodeships. The description of the subject of the contract is contained in Annex No. 1 to SWZ. Due to the limited number of characters in the form for submitting notices electronically, further information regarding the procedure is contained below (the numbering is taken from SWZ): 5.1.4 The obligation of the entity providing resources to make the necessary resources available to it for the purpose of implementing the given contract or other evidentiary means confirming that the Contractor, in implementing the contract, will have the necessary resources of these entities, in a situation where the Contractor relies on the capabilities or situation of the entities providing the resources. 5.1.5 The obligation of the entity providing resources, as mentioned in point 5.1.4, confirms that the relationship linking the Contractor with the entity/ies providing resources guarantees real access to these resources and in particular specifies: - the scope of the resources of the entity providing resources available to the Contractor; - the manner and period of making the resources of the entity providing these resources available to the Contractor and their use by him in the performance of the contract; - whether and to what extent the entity providing resources, on the capabilities of which the Contractor relies in relation to the conditions of participation in the proceedings regarding education, professional qualifications or experience, will implement the contract/its part, the indicated capabilities of which relate. NOTICE - The Contractor is obliged to fulfill the information obligation provided for in Article 13 or Article 14 of the GDPR with respect to natural persons from whom personal data has been directly or indirectly obtained (in the case of using Subcontractors/Third Parties/Contractors entering into a consortium) in order to apply for the award of the contract in this procedure. 5.1.6. A declaration from which it will result which parts of the contract will be performed by individual Contractors, in the case of Contractors jointly applying for the award of the contract and in relation to the conditions indicated in point 4.1.5 - prepared according to the template constituting Annex No. 5 to SWZ (if applicable). 5.1.7. A list of persons sent by the Contractor to implement the public contract, in particular those responsible for providing services, together with information on professional qualifications, authorizations, experience and education necessary to perform the public contract, as well as the activities performed by them and information on the basis of possessing these persons. The list should be prepared according to the template constituting Annex No. 7 to SWZ. NOTICE: The submission of lists, as mentioned in points 5.1.7 and 7.11 lit. e), results from Article 126(2) of the Act. The lists are necessary to ensure the proper course of the procedure, due to the application by the Contracting Authority, as a criterion for evaluating offers, of the experience of persons who will be sent to implement the contract, meeting the condition of participation in the procedure, the verification of which requires an assessment of both documents. 5.5 A Contractor entered in the official register of approved contractors or a contractor certified by certifying units meeting the requirements of European certification standards, instead of the evidentiary means, as mentioned in points 5.2.1-5.2.3, may submit a certificate of entry into the official register issued by the competent authority or a certificate issued by the competent certifying unit of the country in which the Contractor has its registered office or place of residence, indicating the evidentiary means constituting the basis for entry or obtaining certification, unless the Contracting Authority has justified reasons to question the information resulting from the certificate or certificate. 5.6 The Contractor is not obliged to submit evidentiary means, as mentioned in Chapter 5 of SWZ, if the Contracting Authority can obtain them using free and publicly available databases, in particular public registers in the sense of the Act of 17 February 2005 on the informatization of the activities of entities performing public tasks, hereinafter referred to as the "Act on Informatization", provided that the Contractor has indicated in the JEDZ data enabling access to these means. The Contractor is not obliged to submit evidentiary means which the Contracting Authority has, if the Contractor indicates these means and confirms their correctness and up-to-date. 5.7 Evidentiary means as well as documents or declarations drawn up in a foreign language must be submitted together with translations into Polish. If the evidentiary means, documents or declarations, as mentioned in Chapter 5 of SWZ, are drawn up in a foreign language, the Contractor is obliged to present their translation into Polish. 7.11 The offer must contain: a) FO drawn up and issued according to the template constituting Annex No. 6 to SWZ, in which, inter alia, the price should be indicated; b) power of attorney or other document confirming the authorization to represent the Contractor - if applicable; c) declarations and documents, as mentioned in point 5.1, with the reservation that documents, as mentioned in points 5.1.4 and 5.1.6 - if applicable; d) justification for the reservation of information contained in the offer as a business secret - if applicable; e) a list "Experience of persons sent to implement the contract", containing information allowing for an assessment in accordance with the offer evaluation criterion specified in point 12.3. The list should be prepared according to the template constituting Annex No. 8 to SWZ. f) a document subject to evaluation in accordance with the criteria indicated in point 12.4 of SWZ, i.e. "Initial concept of conducting a two-day training", containing: a) the complexity and coherence of the concept; b) the diversity of activating and workshop methods; g) in the case of submitting defects in a form other than monetary, the original defective document (guarantee or surety). 16.1 The projected provisions of the contract constitute Annex No. 2 to SWZ.
