Description

The subject of the contract is: SERVICE FOR THE PREPARATION OF FULL-DAY AND DAILY MEALS FOR PATIENTS OF THE SILESIAN VOIVODESHIP SPECIALIST HOSPITAL NAMED AFTER N.M.P. IN CZĘSTOCHOWA, FROM OWN PRODUCTS, BASED ON THE KITCHEN OF THE CONTRACTOR, INCLUDING THE TRANSFER OF EMPLOYEES UNDER ART. 23 OF THE LABOUR CODE, EMPLOYED IN THE FOOD DEPARTMENT. 2. The detailed scope of the contract is specified in Annex No. 3 to the SWZ – „Description of the subject of the contract”. Other conditions related to the implementation of the contract are specified in the Draft Contract Terms, constituting Annex No. 10 to the SWZ. 3. The contracting authority requires contractors to conduct a site visit of the contract implementation site in order to obtain all data that may be useful for preparing an offer and implementing the subject of the contract. The contractor will bear the costs related to participating in the site visit. Offers from contractors who do not participate in the site visit will be rejected under art. 226(1)(18) of the Pzp Act, which states: „The contracting authority rejects an offer if: it was submitted without a site visit or without checking the documents necessary for the implementation of the contract available at the contracting authority, in cases where the contracting authority required this in the contract documents”. In the case of contractors jointly applying for the award of the contract (consortium), the contracting authority will consider the obligation fulfilled if at least one of the consortium members or a proxy appointed by one of the consortium members participates in the site visit. 4. The contracting authority does not allow partial offers to be submitted. 5. Reasons for not splitting the contract: The contracting authority does not allow the possibility of submitting partial offers. Offers in the procedure can only be submitted in relation to the entire contract. The contract is indivisible, the service must be performed by one contractor due to the need to ensure the maximum health safety of patients, technological continuity and the integrity of the hospital's assets. The entire food process – from the delivery of raw materials, through the production of therapeutic diets, to distribution to wards – constitutes one, indivisible technological and logistical chain. Delegating these tasks to several contractors would make it impossible to coordinate meal delivery times with the work of medical staff and would disperse responsibility for the sanitary regime (HACCP) and the epidemiological cleanliness of the facility. Additionally, the service is related to the lease of the hospital kitchen premises, which constitute a compact, indivisible architectural and functional whole.
