The subject of the order is successive deliveries of light heating oil type "Ekoterm Plus" or equivalent, hereinafter referred to as "oil", in a maximum quantity of 192 000 litres, in accordance with the current needs of the Purchaser, as follows: 1) 30 000 litres to the Municipal Office in Prusice (hereinafter UM in Prusice) at ul. Rynek 1; 2) 124 000 litres to the Primary School named after Henryk Sienkiewicz in Prusice (hereinafter SP in Prusice) at ul. Żmigrodzka 43; 3) 10 000 litres to the Primary School named after Maria and Lech Kaczyński in Skokowa, ul. Kościelna 10, 55-110 Prusice, including the school building in Piotrkowice 19; 4) 8 000 litres to the Volunteer Fire Department in Prusice, at ul. Powstańców Śląskich 17; 5) 20 000 litres to the Social Services Centre in Prusice, ul. Żmigrodzka 39, 55-110 Prusice. 2. The quantities of oil indicated may change depending on the needs of the Purchaser. 3. The Contractor has no claims in the event of partial or complete non-utilisation of the quantities of heating oil indicated in point 1. 4. The price per litre of oil will include all the Contractor's costs, including transport, loading and unloading costs, etc. 5. The order concerns deliveries of light heating oil "Ekoterm Plus" or equivalent with the following parameters (quality standards): − appearance (20 °C, 101.3 kPa): liquid, red colour, − odour: characteristic, − density at 15 °C maximum 860 kg/m3 − flash point: > 56 °C, − calorific value not less than 42.6 MJ/kg, − kinematic viscosity (20 °C): ≤6 mm2/s, − fractional composition: • up to 250 °C distils not more than 65 % (V/V), • up to 350 °C distils not less than 85 % (V/V), − sulphur content not more than 0.2 % (m/m), − coke residue not greater than 0.3 % (m/m), − ash residue not greater than 0.01 % (m/m), − water content not greater than 200 mg/kg, − pour point not higher than -20 °C, − cloud point 1 °C; − solid contaminant content not more than 24 mg/kg. 6. The Contractor guarantees, through analyses carried out on each batch of oil, that the goods will be in accordance with the quality conditions set out in the order confirmation. 7. The Contractor will attach a current certificate to each delivery, certifying the quality of the delivered heating oil. 8. The Purchaser reserves the right to subject a randomly selected sample of the heating oil delivered by the Contractor to laboratory control without notifying the Contractor, in order to check the quality of the delivered and used heating oil for compliance with the physico-chemical properties specified in this SWZ. 9. The tests will be carried out in the Contractor's laboratory or in an independent accredited laboratory (e.g. the Institute of Chemistry and Technology of Oil and Coal of the Wrocław University of Technology) or any other accredited laboratory from among those specified above, it is up to the Purchaser, who may request the tests to be carried out in both centres at the same time. 10. The disclosure by means of laboratory tests of non-compliance of the parameters defining the properties of the sample of heating oil of the given delivery with the parameters specified in the contract, will be considered non-compliant with the order and will be subject to complaint. 11. In the event of a complaint by the Purchaser about the quality of the oil, the Contractor agrees to carry out detailed tests in an independent laboratory. The cost of carrying out the tests is borne by the party depending on the result. 12. In the event of a quality or quantity complaint, the Contractor undertakes to deliver the appropriate, order-compliant quantity of heating oil free from defects or, in the case of a quantity complaint, within a maximum of 48 hours from the complaint. 13. In the event that the defective oil is poured into the Purchaser's tanks, in which the oil will be located, the Contractor will be obliged at its own cost to replace all the oil, in accordance with the quantity in the tank after it has been filled by the Contractor. 14. Delivery of the heating oil will take place at the price in force on the day of delivery of the advertised oil or on the day on which the delivery was to take place, in the event of quantity shortages. 15. Deliveries of oil will take place successively each time following a telephone notification of the requirement by the employees indicated in the contract. 16. The detailed description of the subject of the order is contained in Annex No. 5 to the SWZ - draft contract.
