Description
1. The contracting entities described in Chapter I of the SWZ will jointly conduct a procurement procedure (Article 38 of the Pzp Act), with the authorized contracting entity – the Group Purchasing Leader – being the Municipality of Rypin. 2. The subject of the procurement is the supply of electrical energy from 01.01.2027 to 31.12.2027. 3. The procurement will be awarded in two parts. The contractor may submit an offer for any number of parts. 1) Part 1 of the procurement – Supply of electrical energy to premises and facilities. 2) Part 2 of the procurement – Supply of electrical energy for street lighting. Detailed description of the individual parts of the procurement is given in Sections III.1, III.2. 4. Data on the quantity of electrical energy to be purchased are indicative. The quantity of electrical energy has been estimated based on historical data on electricity consumption, taking into account projected changes in use and actions taken by the contracting entities, as mentioned in Article 37 of the Act of 7 October 2022 on special solutions to protect electricity consumers in 2023 and 2024 in connection with the situation on the electricity market and the estimated quantity of electricity generated in generating installations. The contractor should take into account possible fluctuations in electricity consumption. A decrease or increase in the quantity of electricity will not have any consequences for the contracting entities (consumers), except for the need to pay for the actual quantity of electricity consumed. The indicated estimated quantity is the quantity that the contracting entities intend to purchase, taking into account the quantity of electricity produced in-house and consumed as self-consumption. 5. Quality standards 1) The subject of the procurement are supplies of electrical energy with specified quality standards in accordance with applicable regulations. 2) The quality standards of electrical energy are described in the Pe Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on detailed conditions for the operation of the power system (i.e. Journal of Laws 2025 item 919 with later amendments). 3) The rules for shaping and calculating tariffs and settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trading (i.e. Journal of Laws 2024 item 904 with later amendments). 6. Details regarding electricity consumption are described in Annexes No. 1a and 1b to the SWZ List of points of consumption. 7. Settlement periods applied: Conventionally applied settlement periods (the contracting entity does not have detailed data relating to individual PPE) Tariff group Bx, C2x – 1 month Tariff group C1x, G – 2 months. 8. Based on the Power of Attorney granted, the contractor will be obliged to submit, on its own behalf and on behalf of the contracting entity (consumers), the agreement to the relevant OSD in accordance with applicable regulations and to represent it before the OSD in the process of changing the supplier. 9. Distribution services are/will be provided on the basis of separate agreements concluded between the contracting entities (electricity consumers) and the OSD. 10. The distribution system operator – as described in Annex No. 1a and 1b to the SWZ column “Distribution System Operator”. 11. The condition for starting the supply of electrical energy at the specified time (with regard to individual points of consumption) is the positive completion of the supplier change procedure, the consumer having a valid agreement for the provision of electricity distribution services and the registration of the changes made by the OSD and the effective termination/expire of the currently valid electricity supply agreements/comprehensive agreements: 1) In the case of agreements requiring termination, the contracting entities (consumers) will submit (with regard to individual points of consumption) the appropriate declarations of termination of agreements with effect from the day preceding the planned start date of supplies (as described in Annex No. 1a/1b to the SWZ column “Supply Period”) - termination of agreements will not be the responsibility of the contractor. 2) In the case of having time-limited sales agreements, their validity period expires on the day preceding the planned start date of supplies (as described in Annex No. 1a/1b to the SWZ column “Supply Period”). 12. In the case of points of consumption where the separation of sales and distribution agreements has already taken place (next change of supplier), the contracting entities (consumers) have distribution agreements concluded for an indefinite period. 13. In the case of points of consumption for which the change of supplier will take place for the first time (and currently comprehensive agreements are in force), the contractor will be authorized by the contracting entity to: 1) submit applications for the conclusion of distribution agreements for an indefinite period 2) conclude, on behalf of and for the benefit of the principal, agreements for the provision of electricity distribution services for an indefinite period. 14. In the event that changes occur during the term of the agreement regarding the Purchaser/Consumer requiring the conclusion of a new distribution agreement, the contracting entity may grant the contractor the appropriate Power of Attorney or conclude an agreement individually. 15. The procedure does not cover PPE (tariff group G) where the electricity will be intended for domestic purposes. 16. The contracting entity will make use of Article 139(1) of the Pzp Act, i.e. first of all examine and evaluate the offers, and then qualify the contractor whose offer was most highly evaluated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure.
