The Subject of the Contract is the supply of parts for the electronic system of Inspiro vehicles, divided into 7 Tasks. 2. The Subject of the Contract includes the supply of parts listed in the „List of Ordered Parts”, being Annex No. 1 to the Technical Specification (hereinafter: „TS”), being Annex No. 1 to the SWZ and being an integral part thereof. 3. The Contracting Authority requires the implementation of the Subject of the Contract in batches according to the delivery schedule contained in Annex No. 1 to the TS. Provisions regarding the possibility of partial deliveries within a given batch have been included in the TS. 4. The delivered parts must be factory new, unused (by factory new, unused, it is meant parts originally packaged, not having signs of use). 5. The Contractor will provide a 24-month warranty on the delivered parts on the terms indicated in the Contract Template, being Annex No. 2 to the SWZ and being an integral part thereof. For a period equal to the period of the warranty granted, the Subject of the Contract will be covered by a warranty. 6. The Subject of the Contract will be implemented in accordance with the documentation of the procedure, i.e. this SWZ and its annexes, in particular the TS and the Contract Template. 7. The Contracting Authority does not have the possibility to describe the Subject of the Contract in a manner referred to in Article 99(4) of the Pzp Act, i.e. without indicating trademarks (catalogue numbers of the manufacturer), and the use of the manufacturer's catalogue numbers is justified by the specificity of the Subject of the Contract. 8. Taking the above circumstances into account, in accordance with Article 99(5) of the Pzp Act, the Contracting Authority allows the submission of an offer for equivalent parts to the original parts indicated by the Contracting Authority in Annex No. 1 to the TS. In the case of offering equivalent parts: - they must have the same parameters as the original parts, - they must meet the functional requirements of the original parts, - they must be compatible with the other elements of the vehicle, - the installation of equivalent parts on the vehicle must not result in a high risk of change, which means that the changes as a result of the use of equivalent parts must be reversible and in the event of a failure their use will generate low failure consequences, - the Contracting Authority requires that the manufacturer of the equivalent parts has a Quality Management System implemented in its enterprise. 9. The Contractor who offers the supply of equivalent parts is obliged to: - declare in the Offer Form submitted on the procurement platform Marketplanet that it offers and will deliver equivalent parts, - indicate in the Offer Form the positions from Annex No. 1 to the TS, for which it offers equivalent parts, - include in the Offer Form the data of the offered equivalent parts, i.e. the names of the equivalent parts, the manufacturers of the equivalent parts, the catalogue numbers/marks of the equivalent parts, where the obligation of the Contractor is to describe the offered equivalent parts in the offer in a way that allows the Contracting Authority to unambiguously determine which equivalent parts the Contractor offers in a given position of the offer form (a given position of Annex No. 1 to the TS), - submit with the offer the evidential means referred to in point 12 of the SWZ.
