Description

The subject of the procurement is the supply of electricity, including the sale of electricity for the power supply points indicated in Annexes 1a, 1b, 1c to the SWZ for a period of twelve months starting from 01.01.2027. 2. The supply of electricity will be made under the conditions specified in the Act of 10 April 1997 – Energy Law, as well as in accordance with the executive regulations issued to this Act, in particular with the quality of service standards for recipients specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trading. 3. The subject of the procurement has established quality standards. The quality parameters of electricity in the distribution part are regulated by the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the functioning of the power system. 4. The procurement must be realized in accordance with the requirements contained in this Specification of Procurement Conditions, Detailed Description of the Subject of the Procurement, together with an example of completing data in the contract and on the invoice, which is Annex 1 to the SWZ, as well as in the lists of power supply points, which are Annexes 1a, 1b, 1c to the SWZ, and the draft clauses of the contract, which are Annexes 2a, 2b, 2c to the SWZ. 5. The applicable law for this procurement (including for the contract concluded as a result of this procedure and for the assessment of the legal consequences of all documents in this procurement) is Polish law, taking into account the law of the European Union. 6. The contracting authority does not reserve the possibility of applying for the procurement exclusively by contractors, as mentioned in Article 94 of the Pzp. 7. The contracting authority does not allow the possibility of submitting a variant offer, as mentioned in Article 92 of the Pzp, i.e. an offer providing for a different method of executing the procurement than specified in this SWZ. 8. The contractor who refers to equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the contracting authority. In such a case, the contractor attaches to the offer a list of equivalent solutions along with its description or standards. 9. The contracting authority does not envisage the conclusion of a framework agreement and the establishment of a dynamic purchasing system, and does not envisage the selection of the most advantageous offer using an electronic auction. 10. The contracting authority does not envisage granting orders based on Article 214(1)(8) of the Pzp. 11. The contracting authority does not allow the submission of an offer in the form of electronic catalogues or the attachment of electronic catalogues to the offer, in the situation specified in Article 93 of the Pzp. 12. The contracting authority does not envisage settlement in foreign currencies. The settlement of the procurement is made in PLN. 13. Subcontracting: 1) The contractor may entrust the execution of part of the procurement to a subcontractor (subcontractors); in connection with the realization of the procurement, the contracting authority does not reserve the obligation of personal execution of key tasks of the procurement, 2) The contracting authority requires that in the event of entrusting part of the procurement to subcontractors, the contractor indicate in the offer the parts of the procurement, the execution of which he intends to entrust to subcontractors, and provide (if they are already known) the names of these subcontractors, entrusting the execution of part of the procurement to subcontractors does not release the contractor from responsibility for the proper execution of the procurement, 3) The contractor may change subcontractors during the term of the contract within the scope indicated in the offer - such a change may not affect the realization of the contract, 4) in the event that the change or resignation from the subcontractor concerns an entity, on whose resources the contractor referred in accordance with Article 118(1) Pzp in order to demonstrate the fulfillment of the conditions of participation in the procedure, the contractor is obliged to demonstrate to the contracting authority that the proposed other subcontractor or the contractor himself independently meets them to the same extent as the subcontractor, on whose resources he referred during the procedure for the grant of the procurement, 5) in the event of non-payment to subcontractors, the contracting authority reserves the right to suspend payment to the contractor until he settles his financial obligations. 18. The procurement has been divided into three parts, the contractor may submit an offer for any part/parts of the procurement. - The planned contract execution time is 12 months, with the commencement of deliveries not to start earlier than from 01.01.2027. Thus, the planned delivery realization period is from 01.01.2027 to 31.12.2027. - The supply of electricity to individual PPE will take place after the successful termination of the current electricity supply contracts and the positive completion of the supplier change procedure.
