Description
The Contracting Authority informs that, pursuant to Article 139(1) of the Public Procurement Law, it may first conduct an examination and evaluation of tenders, and then carry out the qualification of the Contractor whose tender has been the highest evaluated, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. In the procedure for awarding a public contract, communication between the Contracting Authority and the Contractors takes place using the e-Zamówienia Platform, which is available at: https://ezamowienia.gov.pl. The use of the e-Zamówienia Platform is free of charge. A Contractor intending to participate in the procedure for awarding a public contract must have a "Contractor" account on the e-Zamówienia Platform. Detailed information on setting up accounts and the rules and conditions for using the e-Zamówienia Platform are specified in the e-Zamówienia Platform Regulations, available at the website https://ezamowienia.gov.pl/pl/regulamin/#regulamin-serwisu and information provided in the "Help Centre" tab. Viewing and downloading public content of the procedure documentation does not require having an account on the e-Zamówienia Platform or logging into the e-Zamówienia Platform. The method of preparing electronic documents or electronic documents being an electronic copy of content recorded in paper form (digital reproduction) must be in accordance with the requirements specified in the regulation of the President of the Council of Ministers of 30 December 2020 on the method of preparing and transmitting information and technical requirements for electronic documents and electronic communication means in the procedure for awarding a public contract or a tender. Electronic documents, referred to in § 2(1) of the regulation, referred to in point 11.6 of the SWZ, are prepared in electronic form, in data formats specified in the regulation of the Council of Ministers of 12 April 2012 on the National Interoperability Framework, minimum requirements for public registers and exchange of information in electronic form and minimum requirements for ICT systems, taking into account the type of data being transmitted (the Contracting Authority also allows the RAR format) and are transmitted as attachments. In the case of formats referred to in Article 66(1) of the Public Procurement Law, the above regulations will not apply directly. Information, declarations or documents, other than those listed in § 2(1) of the regulation, referred to in point 11.6 of the SWZ, transmitted in the procedure are prepared in electronic form: a) in data formats specified in the regulation of the Council of Ministers on the National Interoperability Framework (the Contracting Authority also allows the RAR format) taking into account the type of data being transmitted (and are transmitted as an attachment), or b) as text entered directly into the message sent using electronic communication means (e.g. in the body of an email message or in the body of the "Communication Form"). If electronic documents, transmitted using electronic communication means, contain information constituting a business secret within the meaning of the provisions of the Act of 16 April 1993 on combating unfair competition (i.e. Journal of Laws of 2022, item 1233 as amended), the contractor, in order to maintain the confidentiality of this information, transmits it in a separate and appropriately marked file, with simultaneous indication in the file name "Document constituting a business secret". Communication in the procedure, with the exception of submitting tenders (the method of submitting tenders is described in Section 13 of the SWZ), takes place electronically via communication forms available in the "Forms" tab ("Communication Forms"). In particular, invitations and notifications, questions and answers are exchanged via the "Communication Forms". The "Communication Forms" also allow an attachment to be added to the sent message (the "add attachment" button). The possibility of using the "Communication Forms" in the procedure in full scope requires having a "Contractor" account on the e-Zamówienia Platform and logging into the e-Zamówienia Platform. To use the "Communication Forms" used to ask questions about the content of the contract documents, it is sufficient to have a so-called simplified account on the e-Zamówienia Platform. All messages sent and received in the procedure by the Contractor are visible after logging in to the procedure overview in the "Communication" tab. The maximum size of files sent via the "Communication Forms" is 150 MB (this size applies to files sent as attachments to one form). The minimum technical requirements regarding the equipment used to use the services of the e-Zamówienia Platform and information regarding the connection specification are specified in § 12 of the e-Zamówienia Platform Regulations, namely: In order to properly use the services of the e-Zamówienia Platform, the following is required: a) PC Computer: minimum parameters: Intel Core2 Duo, 2 GB RAM, HD, one of the following operating systems installed: MS Windows 7 or newer, OSX/Mac OS 10.10, Ubuntu 14.04, one of the following browsers installed: Chrome 66.0 or newer, Firefox 59.0 or newer, Safari 11.1 or newer, Edge 14.0 and newer, or b) Tablet/Phone: minimum parameters: 4-core processor, 2GB RAM, Android 6.0 Marshmallow, iOS 10.3, Chrome 61 browser or newer. In case of technical problems and failures related to the operation of the e-Zamówienia Platform, users can use technical support available electronically via a form provided on the website https://ezamowienia.gov.pl in the "Report a problem" tab.
